I wish I could have asked Vicky Toensing a couple of questions:
1. Did you provide legal advice to anyone in the Administration prior to the publishing of Mrs. Wilson's identity as a CIA employee, as to how to avoid the provisions of the IIPA?

2. Did you provide legal advice to anyone in the Administration after the publishing of Mrs. Wilson's identity as a CIA employee, as how to avoid prosecution of the IIPA?

3. Were you coached in any way, as to what you should say in an appearance on any news network or before an interview with some other news media, by the White House or anyone else in the Administration? (This may include talking points.)

4. Were you coached in any way, as to what you should say in your appearance today before the House Committee on Oversight and Government Reform, by the White House or anyone else in the Administration?

5. Would you have any knowledge about whether or not Mrs. Wilson served outside the United States within the five years prior to July 14, 2003? (As per the definition of "covert agent" in 50 U.S.C. 426 (4a(i)))

Mrs. Toensing, you say Valerie Plame is not covert under the statue that you wrote for Goldwater to define punishment for outing a CIA agent. Did you write the law that created the CIA? That would be the law that defines what a covert CIA agent is.
You say you were 25 when you wrote the Goldwater statute. Wouldn't you be about 5 years old when the law creating the CIA was written?

This needs to be pointed out to Waxman. The committee totally missed this point.

4. Supposedly she wrote the law regarding the outing of covert CIA agents
As I understand from her testimony the law as she wrote it makes it almost impossible to prosecute anyone because the standards are so high.That is why she doesn't think Valarie has a case. Also that may be why the WH wasn't worried, they knew they could get around the outing of Plame with the help of Toensing.

5. Look at this interesting bit from her law firm profile:
While Chief Counsel for Senator Barry Goldwater, Chairman of the Senate Select Committee on Intelligence, 1981-1984, Toensing was instrumental in winning passage of two important bills: (1) to protect the identities of intelligence agents and (2) to protect certain classified information from disclosure under the Freedom of Information Act.

Would you please furnish the Committee with a complete listing of all your sources of income for the last five years, including payments, emoluments, or any other consideration from any source for television panel discussions, columns, and other media appearnces.

That is to say, who's doling out the payola for you to peddle your lies?

9. She did write an amicus brief
with the court for Matt Cooper and Judith Miller which included; "there exists ample evidence in the public record to cast serious doubt as to whether a crime has even been committed under the Intelligence Protection Act in the investigation underlying the attempts to secure testimony from Miller and Cooper."

"Ms. Plame didn't have a cover to blow, citing a July 23, 2004 article in the Washington Times which argued that Valerie Plame's status as an undercover CIA agent may have been known to Russian and Cuban intelligence operations prior to the article (by Robert Novak) that revealed her status as a CIA employee."
