Simple question: Do you think Vice President Cheney will still be in office on Inauguration Day 2009?

2. I think if he were imprisoned he would have either resigned or been impeached by then.

3. I don't look for The Foulmouthed Gargoyle to go peacefully

and I believe that - short of a health problem that rendered him comatose - he would hang onto his office tooth & nail. I also believe he would attempt to ride out impeachment. IMO it would take the palpable threat of indictment and/or imprisonment to convince him that resignation is his best move.
