When I saw TPM had posted the first round, I just about fell off of my chair. I was so excited to post them here, I called them memos.

Page 11...mentions Issa. He apparently was complaining about Lam's lack of prosecuting immigration cases. Isn't Issa tied up in the Cunningham/Abramoff scandal? Weeee!!

15. Issa: 'Congress was lied to.' Calls for ouster of attorney general if...
U.S. Rep. Darrell Issa said Wednesday he was "outraged" that executive branch officials recently gave a congressional hearing misleading and inaccurate testimony based on information that both the Department of Justice and the White House knew to be untrue.

...

Issa said Wednesday that he never made any complaints to Gonzales' office or to the White House relating to the Cunningham matter, and his only problem with Lam related to her prosecution rate on human smugglers and firearms cases.

16. here's a summary of part one. Carol Lam.
Edited on Mon Mar-19-07 10:25 PM by robinlynne
Darrell Issa started a knockout fight with carol lam, based on a fake document he got from 2004, saying that border patrol agents were furious because prosecutors in san Diego were not prosecuting the people they caught. the document was written by a border patrol agent, unnamed, and not authorized by the heads of border patrol. He sent a scathing letter to justice criticizing carol lam. This is happening in June of 2006. Lam wrote back, that inf act, the document was from 2003, had been altered, and was unverifiable. saying if you want to meet about it, let's deal with facts.
Issa then got scores of repub signatures on an even worse letter to justice. here are some of the names of repu=bs who signed:

Pombo
Randy Duke Cunningham
Nunes
Doolittle
Mary Bono

19 in all, can't read all the names.

Then Issa went on CNN saying that Lam wasn't prosecuting smugglers of "illegal aliens'. just catching and releasing.

Lam wrote a letter back with the facts.

Feinstein also wrote to th Justice dept asking what was going on with the prosecutions.

This chapter ends with a letter from DOJ (assistant AG) to Issa, and another to Feinstien, saying that priorities had been established; the prosecutors were doing exactly what they were supposed to be doing. In fact, LAm had 50% of her people on illegal immigration, and these priorities had been okayed by the border patrol. In other words, his complaint from border patrol was bullshit.

64. Total Rove stooge
He was also behind voter roll purges during the 2004 election.

"But the Committee missed a big one: Timothy Griffin, Karl Rove’s assistant, the President’s pick as US Attorney for the Eastern District of Arkansas. Griffin, according to BBC Television, was the hidden hand behind a scheme to wipe out the voting rights of 70,000 citizens prior to the 2004 election.

Key voters on Griffin’s hit list: Black soldiers and homeless men and women. Nice guy, eh? Naughty or nice, however, is not the issue. Targeting voters where race is a factor is a felony crime under the Voting Rights Act of 1965.

In October 2004, our investigations team at BBC Newsnight received a series of astonishing emails from Mr. Griffin, then Research Director for the Republican National Committee. He didn’t mean to send them to us. They were highly confidential memos meant only for RNC honchos. ... And we dug in, decoding, and mapping the voters on what Griffin called, “Caging” lists, spreadsheets with 70,000 names of voters marked for challenge. Overwhelmingly, these were Black and Hispanic voters from Democratic precincts.

The Griffin scheme was sickly brilliant. We learned that the RNC sent first-class letters to new voters in minority precincts marked, “Do not forward.” Several sheets contained nothing but soldiers, other sheets, homeless shelters. Targets included the Jacksonville Naval Air Station in Florida and that city’s State Street Rescue Mission. Another target, Edward Waters College, a school for African-Americans. If these voters were not currently at their home voting address, they were tagged as “suspect” and their registration wiped out or their ballot challenged and not counted."

31. pages 10 thru 15
Carol Lam issues a statement after Issa, appearance on Lou Dobbs complaining about her refusal to prosecute 100% of alien smugglers. Lam says Issa issued an alterd and unauthorized version of of an older border patrol report for one substation. The person altering the document is unknown. The original date of the report 2003 was altered to 2004 and contained editorial and commentary that had never been approved by the border patrol.

It also looks like AP reporter Elliott Spagot who also arrived on the scene in 2003 to look into immigrant smuggling and get the ball rolling criticizing USAs he writes in an article that says the justice department declined comment but that Representative Ric Keller R- FL told AG Gonzales that Carol Lams record on immigration smuggling was a Pathetic failure and that gonzales replied that he was urging USA to more activly enforce laws but noted that immigration cases created a tremendous strain.

and it goes on... I don't know if it's anything. Spagot and Issa looks like they made a concerted effort to work together on this and then played Lou Dobbs.

Issa's "Border Patrol Report" another fucking forged document.

Also, any DU Lou Dobbs "immigration hatin'" fans can eat it. The man is an obvious tool for right wing flacks like Mr. Issa that are running some sort of weirdo Rove operation, as here. It seems fairly obvious that the forged "Border Patrol Report" was yet another in a series of forgeries emanating from the Karl Rove Printing Company, LLC (as in, limited fucking liability, for real).

Edited on Mon Mar-19-07 10:59 PM by Marie26
Cummins, one of the 8 fired prosecutors, got a call from the Eaton at the Deputy Att. General's Office. Eaton said that if Cummins continued to speak out about the forced resignations, they would "retaliate" against him in some unspecified way. Cummins said there was a "threatening undercurrent" to the call. Cummins then sent an email to all the other fired prosecutors, warning them that there could be payback from the DOJ if they spoke to the media or testified before Congress. WOW.

http://judiciary.house.gov/media/pdfs/DOJDocsPt1-3070319.pdf

Page 2 a memo from Elston illustrating budget cuts that keep coming and that the Western Washington office is hemorrhaging prosecutors and support staff. They may not be as responsive to the requests for action on cases referred to them.

A typical story of underfunding and then blaming the underlings who can't produce results.

It seems McNulty liked OneDOJ, and McKay supported the software they were using in the Washington office. The software was made or managed by http://www.csmweb.com/index.htm">CSM (a totally bullshitty sounding corporate "productivity" consultancy) owned by one Tom McWeeney.

Debra, formerly the USA of Central District of California resigned in October of 2006, and went on to a career at Gibson, Dunn & Crutcher.

Debra did very well for her party by investigating/indicting 23 Democratic elected officials & candidates between 2001-2006, as compared to only 4 Republicans. Heckuva job, Debra.

3-19-2007 DOJ-Released Documents 1-3 page 25.

From: Kyle Sampson
I am only in favor of executing on a plan to push some USAs out if we really are ready and willing to put in the time necessary to select candidates and get them appointed — it will be counterproductive to DOJ operations if we push USAs out and then don’t have replacements ready to roll immediately. In addition, I strongly recommend that, as a matter of Administration policy, we utilize the new statutory provisions that authorize the AG to make USA appointments. We can continue to do selection in JSC, but then should have DOJ take over entirely the vet and appointment. By not going the PAS route. We can give far less deference to home-State Senators and thereby get (1) our preferred person appointed and (2) do it far faster and more efficiently, at less political cost to the White House.

Otherwise, I didn't see anything other than documents carefully calculated to support the WH company line. It appears that they have built a case to support a "valid" explanation for having asked each of the USAs to resign. In most cases the explanations are amorphous, consisting of criticisms based on suibjective observations on which reasonable minds could differ, but their response will be, "prove that it was not these reasons, but rather the public corruption investigations, that formed the basis for these USAs being canned."

Unless there exists correspondence that has yet to see the light of day, or some brave soul comes forward to testify about communications that were not reduced to writing, I have a sick feeling that the bastards are going to get away with it. But then, that might just be the sleep deprivation talking.

121. They talk about pushing the USA'a out. And...
Cummins writing to Elston about Tim Griffin Page 32 of doc 1-6

Cummins's wife blames Tim Griffin for "getting the controversy started that led to all the hearings, etc"
and...
"If I (Cummins) testified I don't think I could screw this up any worse than Tim and the White House have done---and it might help---DOJ's call."

The administration is in some hot water, jelly.

125. If you haven't read it yet...
Do read the Cummins letter I referred to. The whole email is very interesting. They wanted Cummins to write a recommendation for Griffin. But Cummins's wife didn't want him to. She blames Griffin for this whole mess. This is a finger pointing to Rove and Griffin for cooking up the whole deal. Just as DUers surmised since day one.

But dig it - if the wife of a US Atty knows who to blame, how secret could it be that this is a White House scheme? The hard part is getting the ducks in a row and quacking. Meantime Cummins is promising to get his wife to let him write the recommendation. Oh, to be a fly on the wall at the Cummins house in those days. He's playing ball with the administration and she's out for blood.

I'm blathering now. Time for sleep.

they kept the draft letters to both Issa and Feinstein.

134. Here is a question for you
Why should a USA need to notify DC when meeting a Congressman representing the district? I may be naive, but I think it is a valid question. Also so far they are trying to remove the good perfoance from the letters

Thanks so much for clearing that up. I had no idea what to make of all that Griffin/Cummins stuff. Guess I had not been following that aspect of this scandal too closely. Veeery interesting, indeed. Cummins' wife sounds like quite a lady. :-)

124. I can see how saying they are "pushing out" the USAs sounds bad.
Edited on Tue Mar-20-07 02:53 AM by jelly
But I'm not having success trying to wrap my mind around the significance of the Cummins/Griffin correspondence you point out (which I read).

Maybe it would help if I understood: how did Tim start the controversy?

Beyond that, I read the reference to the WH screwing things up to possibly being a simple reference to the benign explanation by many Repubs that the WH should have been more blunt and upfront from the get-go about the reasons for the dismissals -- that they acted as though they had something to hide when in fact, they were entirely within their rights to dismiss these USAs.

Thanks for any light anyone can shed on this. Nobody wants to see these idiots suffer more than I, but I ask questions because I sense we're going to need not just good but great evidence if it is to withstand the Republican spin-machine.

**edited to say, on the Tim issue -- just read eleny's response above and now I GET IT.

128. Evidently, Cummins's wife knows the score
It's not a matter of any one communication they've uploaded. They aren't going to upload a real smoking gun. But they're terribly stressed over their right now and some mails with tidbits like these are slipping through. It's the drip drip drip that will help the committees. With these, they will ask pointed questions to people under oath and ask for more documents. Others might come forward to fill in the blanks.

Time for sleep. Goodnight.

139. way at the end of the docs, feinstein says to gonzalez, during the first hearing
in january that the law says: when an attorney completes their 4 years, THEY STAY IN OFFICE, until the next attorney has been appointed and vetted. She read the law to him. They're going to pass a law this week taking the interim appt away from gonzales, and giving it ot the circuit court. I would love to see san diego appoint Carol Lam! The white house could only take her out after senate approval...
