About the new AG appt...it just occurred to me....
I heard on one of the MSNBC shows - maybe Olbermann
to paraphrase...
well, they're having a hard time finding anybody to thnk of nominating...
...well, you know, JFK just got his BROTHER TO BE AG
and I thought OMIGOD! his BROTHER!
guess who's not very busy about now>

you think he'd do that?

8. Do you have a reference for that law?
Just curious.. Unless there is a sunset on that law or some other provision, I would wonder if that would require a Constitutional Ammendment. Not that Jeb would be qualified to be A.G.

13. I don't know about Jeb, but I wouldn't put it past Bush to make a recess appointment
The Senate only has to be in temporary recess for 3 days and the President can make an interim appointment if the position is vacant during the recess. The interim appointment is valid to the end of the Senate's current session and until the end of the next one, meaning that someone could be appointed without Senate approval for the next year and a half. Easter break might be on the schedule for Bush. At least, I think that's what the Executive Branch's recess appointment power would allow. And of course Bush would try to push the law right up to the limit, as he's been doing since day 1.

Article II, Section 2 of the U.S. Constitution: "The President shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their next Session."
