Harriet/Bill, please see the attached. Please note (1) the plan, by its terms, would commence this week; (2) I have consulted with the DAG, but not yet informed others who would need to be brought into the loop, including Acting Associate AG Bill Mercer, EOUSA Director Mike Battle, and AGAC Chair Johnny Sutton (nor have I informed anyone in Karl's shop, another pre-execution necessity I would recommend); and (3) I am concerned that to execute this plan properly we must all be on the same page and be steeled to withstand any political upheaval that might result (see Step 3); if we start caving to complaining U.S. Attorneys or Senators then we shouldn't do it -- it'll be more trouble than it is worth.

We'll stand by for a green light from you. Upon the green light, we'll (1) circulate the below plan to the list of folks in Step 3 (and ask that you circulate it to Karl's shop), (2) confirm that Kelley is making the Senator/Bush political lead calls, and (3) get Battle making the calls to the USAs. Let us know.

4. That's their smokescreen of choice - used it for Plame outing, Downing Street Memos
and even to ignore Kerry's counterattacks on swifts. They use it as a TACTIC.

CNN and MSNBC both use that tactic to downplay whatever would hurt Bush most.

Ahh, yes. Schumer said it on MTP this last Sunday:

(From the NYT) - "Mr. Schumer said his aides had spoken Saturday night to Mr. Sampson’s lawyer, and had received indications that Mr. Sampson “wants to come forward.” Speaking on “Meet the Press” on NBC, Mr. Schumer said, “It’s a real possibility that he will voluntarily testify...”

Deputy Attorney General Paul McNulty noted in an email released among 3,000 pages of others by the White House Monday night that he had "not looked at district's performance" prior to his termination by the Justice Department, the Los Angeles Times revealed Tuesday. "McNulty said in an e-mail two days before the firings that he had second thoughts about Bogden."

"I'm still a little skittish about Bogden," McNulty wrote. "I'll admit (I) have not looked at his district's performance."

Administration officials were upset with Bogden for not bringing enough obscenity prosecutions, the Times wrote.

"They were critical Paul Charlton in Phoenix because he wanted to change Gonzales' mind about a death penalty case in Arizona," the Times wrote. "The documents also show that Washington officials were frustrated with Carol C. Lam of San Diego and David C. Iglesias of Albuquerque for not doing more on border crime cases."

According to new documents released Monday, Deputy Atty. Gen. Paul J. McNulty told Margaret M. Chiara of Grand Rapids, Mich., that "our only choice is to continue to be truthful about the entire matter," and in an e-mail sought to explain the official Bush administration position that the eight federal prosecutors were being let go for performance reasons.

"The word 'performance' obviously has not set well with you and your colleagues," McNulty conceded. "By that word we only meant to convey that there were issues about policy, priorities and management/leadership that we felt were important to the department's effectiveness."

Chiara was complaining vigorously that she was not being given a reasonable answer for her termination. McNulty's attempts to calm the prosecutor came as the other U.S. attorneys were about to testify before Senate and House committees that they were not given sound reasons for their dismissals.

Seems like a good set of questions for them to ask this panel when they come in again.

I barely touched the surface with the new dump last night. I bet there is lots to be mined from them over the next few days too.
