What does all this have to do with the U.S. attorneys scandal? We don't know all the facts yet, but consider how the scandal apparently came to pass.
Officials in the White House managed to sneak into the Patriot Act a provision allowing the president to appoint interim U.S. attorneys without congressional confirmation. Republican partisans on the Hill and elsewhere then apparently began to scour the country for those prosecutors whom they deemed insufficiently zealous in criminalizing the Democratic opposition. Soon, the attorney general of the United States -- George Bush's crony -- began to remove these independent figures and replace them with more compliant prosecutors. The result looks a lot like a systematic attempt to corrupt the federal justice system for short-term political gain.
The purge was possible because, under our Constitution, the attorney general is a presidential appointee. The Senate must confirm an attorney general, of course -- but the confirmation of Alberto Gonzales demonstrates that the Senate's use of its "advice and consent" power is often derisory. It has become conventional wisdom that a president has the right to install "his choice" in a position that not only sets legal policy for the United States but also heads the massive federal law-enforcement apparatus.
http://www.salon.com/opinion/feature/2007/03/09/attorney_general/But why? Why was the
interim appointment of U.S. Attorneys so important? And what did it have to do with the war on terror? Or - was it simply an overt abuse of power?
Could it be that those Attorney Generals who were recently fired refused to shill for the liberty-busting Patriot Act? And maybe fought against Patriot Act II, which still has not been implemented due to opposition and concern surrounding privacy and freedom? After all, this highly secretive administration has from Day 1 demanded strict loyalty and conformity amongst all administration officials in a Nazi-style "if you're not with us, you're against us" mentality.
Seems to me a perfect recipe for a new permanent fascist Republican majority in America. This happened in Texas circa 2002 when the Repubs redistricted in order to give Repubs more seats in the Texas legislature and in Congress. In fact, who was it whose PAC was called "Texans For a Republican Majority?" I believe it was Tom DeLay's. So these guys basically took everything corrupt they were doing in Texas to establish a permanent Republican majority and foisted it on our entire country.
I think Gonzo and company are scared as hell. On the one hand, they want to tell Congress "it's legal because the Patriot Act says so." On the other hand, they don't want to reveal that because it would be a flat out admission they used the Patriot Act purely for political gain, which is not simply reprehensible but illegal. Damned if they don't, damned if they do.
Anyway this is a HUGE issue IMHO, the misuse of the Patriot Act for political gain. This baby is REALLY gonna hit the fan in the days to come.
