I fear that's exactly what will happen, and without immunizing both of them, there's no way to compel them to answer anything.

5. I agree with the three prior posters

Since a congressional hearing is not a criminal trial, if Rove or Miers take the Fifth, the committee will be entitled to presume that any answer they would have given would have been bad for them.

In the court of public opinion, taking the Fifth is the equivalent of confessing.

10. IANAL, but I don't believe "the Fifth" is available in civil proceedings.

It's a protection against self-inCRIMINAtion .... in criminal proceedings. Unless there's a criminal proceeding (investigation, prosecution, indictment, etc.), I doubt it would be permitted.

They'd be cited for contempt of Congress, I believe ... and whatever penalties that confers.

Waterboarding Rove will do three things:

First, it will let us torture Rove some, and that would be worth the price of admission all by itself.
Next, it would allow the American people to see what waterboarding really is, and not what Pigboy says it is.
And finally, it would make it very clear that the preznit that would allow something like that needs to be impeached.
