However, in in United States v. Nixon, the Supreme Court stated: "To read the Article II powers of the President as providing an absolute privilege as against a subpoena essential to enforcement of criminal statutes on no more than a generalized claim of the public interest in confidentiality of nonmilitary and nondiplomatic discussions would upset the constitutional balance of 'a workable government' and gravely impair the role of the courts under Article III."

And said that a judge could decide that the needs of the criminal justice system outweighed the claim of Executive Privilege. But it isn't clear how that ruling would apply to the situation between the Senate and Bush today.

The Supreme Court did rule against there being an absolute right to Executive Privilege, which is good. But since Presidents and Congress have mostly avoided litigating on this issue, it isn't clear at all what the Courts would decide about a claim of Executive Privilege under the current circumstances.

It's all coming back to bite them in the ass. They got him to testify by fighting his executive privledge all the way to the Supreme court. We saw his Grand jury testimony on TV and these ACTUAL criminals want an off the record private meeting.

Get these muthers under the lights, miked-up and on the record. This is how impeachment will happen. One subpoena at a time.
