1. Madoff was a nice guy. Everybody (important) liked him.

He gave generously to charity. He was a pillar of society. That's how the system works.

Some nerd off in the corner who is quiet, loving in a shy way and meticulously honest, but socially awkwards gets nowhere. The phony who looks good and is known to everyone is given a free ride. It was like that in high school, and it is like that in business.

Madoff was a former head of NASDAQ and a big wheel in the elite social circles of Washington and Wall Street. The people in charge of the SEC would have probably considered him a member of their peer-group. That sense of clubbiness and the revolving-door between the titans of finance and the institutions who were supposed to be overseeing them surely contributed to the lack of investigation.
