Our Election Fraud video removed from YouTube :(

After only FOUR YEARS of being up on YouTube, with many many comments, the video made by dzika and me has been removed for copyright violation :( Apparently because of the song we used. It was Butterflies & Hurricanes by Muse - I put the credit on the page! It's not like we were making money off the video, shouldn't it be seen as a form of promotion for the band? WTF? YouTube sucks...there are sooooo many videos on there that use bands' songs. So if anyone is linking to the youtube video anymore, might as well remove your link. The strange thing is, the youtube video still works on my huffingtonpost.com page: http://stolenelection2004.cf.huffingtonpost.com/ I would think it wouldn't still work since YouTube removed it? Weird.

Anyway, I'm kinda pissed, but oh well...funny it took them 4 years to notice :/

Let's say you have a band, someone likes one of your songs and uses it as background music for a fond retrospective look at the Bush years - and they give you credit. Would that make you happy? Isn't it a form of promotion for your band?

2. not really sure what you're saying....
but I can say for sure the band itself is pretty liberal and political, and NOT supporters of Bush, and the video is NOT 'fond' of Bush...I'm kind of confused...

18. My point is,
musicians get to control who uses their work.

When you use someone else's work without their permission, you take away their right to decide how their work is used.

I thought you might get the point if you imagined your own work being used without your permission by a Bush supporter.

20. Yep. If that were mine, I'd want it stopped...
yesterday. And if I didn't find out about it for 4 years because I don't bother to listen to his show, I'd still want it stopped.

(And even if I liked the cause it was being used for and might want to support the cause, I'd probably want to review how it was being used.)

5. Yes, that's the first thing you have to do is get the written permission of any
band's music to use it first. That goes for art work and other artistic properties too.

4. I've noticed that lately...
YouTube has been getting more aggressive about copyright violations.

There have been times when videos were removed within an hour or two after being posted.

For awhile, there was one YouTube regular who took great pride in and boasted about looking for and reporting TOS violators (I'm not certain if he's still around though).

You're right about the randomness and arbitrary deletions.

8. It doesn't work on the Huffington page.
Probably the reason it worked for you was because your browser had it buffered. When I try to play it from that page I get a message saying that it was removed for copyright violations.

Can you add a different soundtrack, with public domain music, and put it back up? That won't fix all of the currently broken links but at least it will be available.

11. The video was made in 'sync' with that song....
It would be hard to redo it with a different song. Also, the whole point was that the lyrics are so fitting for that issue and period of time, especially for those at DU that were following the fraud thing back then. It was my election fraud theme song :(

9. I don't really understand why those chose to take down your video in particular
If you had made a video with "B&H" playing over pics of the guys in the band, I don't think there would have been any problem. There are tons of videos like that all over the place. Does YouTube have guidelines about political videos? I've never posted a video myself so I don't know.

MUSE is my favorite band, BTW.

10. Labels Crack Down On That - Especially Majors
Via the internet, labels have been in the process of setting themselves up to replace radio and MTV (which they already made irrelevant by controlling playlists with their promotional budgets) as the filter source where your music is going to come from.

If you've been paying attention, you've probably already noticed some music videos that have advertising layovers across the image. That's the labels making money, and that's why they won't allow you to use a music piece they have distribution or copyrights over.

My one wish was that y'all had kept the words STOLEN ELECTION as it was in the original title.

Maybe you can re-soundtrack it with some other music, although it would be hard and what you had was great.

Anyway, if Joe the RIAA lawyer (or whoever it was that was responsible for taking the video down) is reading this thread, please know that I'll be crossing Muse off my list of artists to support by buying their works. Thanks to you, Muse just lost a customer and a fan. Hope you are pleased with yourself.

I remember back in the 80's or early 90's (when I was working in the theatre) that some cockamamie lawyers came up with the idea of taxing BLANK audio tape in order to support royalty artists and had a federal bill pending to do it. At the time I needed to records MY OWN works, stuff I wrote and held the copyright to, and was among the many that didn't want to be paying already-rich royalty artists for the 'privilege' of recording my own stuff!

Anyway, it is a great video. Don't let it die, because what we fail to remember we are doomed to repeat.

but at the time, Brad from Brad Blog wanted it to say something less 'stolen' in order to have him host it for us on velvetrevolution....
