Constitutional scholar Tony Snow on ABC this morning:

The executive branch is under no compulsion to testify to Congress, because Congress in fact doesn't have oversight ability. So what we’ve said is we’re going to reach out to you – we’ll give you every communication between the White House, the Justice Department, the Congress, anybody on the outside, any kind of communication that would indicate any kind of activity outside, and at the same time, we’ll make available to you any of the officiels you want to talk to …knowing full well that anything they said is still subject to legal scrutiny, and the members of Congress know that.

Article I; Section 2:

(last paragraph)

"The House of Representatives shall chuse (sic)their Speaker and other Officers; and shall have the sole Power Impeachment."

This last sentence sets up investagitive powers by being able to draw up Aticles of Impeachment. One must have a reason to impeach, and then try an official.

Article I; Section 8:

<snip>

"To make all Laws which shall be necessary and proper for carrying into Execution the foregoing Powers, and all other Powers vested by this Constitution in the Govermnent of the United States, or in any Department or Officer thereof.:

Well this sounds pretty cut and dried to me.

Article II; Section 3:

<snip>

"...he, (the president), shall take Care that the Laws be faithfully executed, and shall Commission all of the Officers in the United States."



There is a reason why the Founders put the Legislative Branch as Article I, especially the House as the focal point: This is where early citizens made a difference in their Congress. Senators, later were elected by direct vote, and the Executive Branch was relegated to Article II. There was to be no amassing of power by an elite element of society. Ever since George Washington, there has been static between Legislative and Executive positions. Not until relatively recently, (beginning w/Reagan), did the Legislative Branch essentially subjugate themselves under the Executive. Without the Legislative Branch taking control of Laws and Enforcement of those Laws, it becomes irrelevant to the Executive. Power checks power, that is what the Constitution is all about.

No one can have their Rights and Liberties "taken" from them, they must be given up by those that have such Rights and Liberties. Thisis why we have been told to be vigilant and to be wary of those within our borders, more so than those outside.
