Who should Obama choose to replace Ted Olson
Ted Olson is currently arguing in Extreme Court to allow a Mine in Alaska to dump it's tailings into a lake. It has been determined that the tailings are toxic and it is against Environmental standards. It went to court and the mine lost, it then went to Appeals court (9th Circuit) and mine lost again, and we all know what Conservatives think of the 9th Circuit Court, so it is now in front of the Right Wing Extreme Court with Ted Olson very aggressively arguing for the Government that the mine should be allowed to do this.. What happens if the case is still being argued after Obama become President, does Ted go bye bye or will he be allowed to continue on with this lousy case...By the way there are alternatives to dumping the tailings into Slate Lake. There is dry stacking and other alternatives as well, but the mine refuses to even consider them..

5. Well, first off, I'm a little confused, because Ted Olson hasn't been S-G since 2004.
But in any case, I don't think Kagan will have much of a problem getting confirmed. She's got a fat resume and is largely controversy-free.

I did not hear the radio announcer correctly it appears. He must have said past Solicitor General and I didn't hear the past part.

But mining company lawyer Theodore Olson told justices that the waste is more accurately defined as "fill." And, after a decade or more of mining, he said, the lake could be restocked with no permanent harm to the environment.
"There will be more fish in a bigger lake, and more livable conditions for the fish and the aquatic life after this process is finished," Olson said.
Justice David Souter called that logic "Orwellian." He said the mining company, Coeur Alaska Inc., and the U.S. Army Corps of Engineers, which granted a permit for the mine, were "defining away" the problem by calling the wastewater discharge fill.
"When you are destroying the entire living (bodies) of this lake, it seems to me that it's getting Orwellian to say there are rigorous environmental standards," Souter said.
Other justices appeared to disagree, noting that an alternative to the dumping would destroy nearby wetlands and create a stack of tailings larger than the Pentagon.
"Isn't it arguable that the best place for really toxic stuff is at the bottom of a lake so long as it stays there?" asked Justice Antonin Scalia.

He left the SG's office in 2004. Garre is SG.


Olson is the lawyer for Coeur d'Alene Mines
