Eighteenth Amendment to the United States Constitution

Amendment XVIII (the Eighteenth Amendment) of the United States Constitution, along with the Volstead Act (which defined "intoxicating liquors" excluding those used for religious purposes and sales throughout the U.S.), established Prohibition in the United States. Its ratification was certified on January 29, 1919. It is notable as the only amendment to the United States Constitution that has been repealed (by the Twenty-first Amendment).

Section 1. After one year from the ratification of this article the manufacture, sale, or transportation of intoxicating liquors within, the importation thereof into, or the exportation thereof from the United States and all territory subject to the jurisdiction thereof for beverage purposes is hereby prohibited.

Section 2. The Congress and the several States shall have concurrent power to enforce this article by appropriate legislation.

Section 3. This article shall be inoperative unless it shall have been ratified as an amendment to the Constitution by the legislatures of the several States, as provided in the Constitution, within seven years from the date of the submission hereof to the States by the Congress.

Incidentally, I made my first trip to the ABC store today. :P (I'm almost 23, but during college I usually just bought cheap beer, etc. from the convenience store.) Good times.

5. Can you imagine what the religious nuts would do if they still had that kind of voting power?

Today, instead of simply banning alcohol, they'd be ordering gays into "re-education" camps in addition to banning abortion. They'd probably pass laws banning all kinds of music and clothing as well. Movies considered too profane would be censored, and certain books would be removed from shelves if not outright burned.

9. What's still idiotic is the fact you are not allowed to distill your own whiskey
However, you can buy it.

You can make your own wine & beer, but not distilled liquor.

Of course, that prohibition allowed my uncles to build a huge still in the swamps of Florida and allowed my dad to run shine in the 1950's.

10. I wonder..during Prohibition... if mere possession of a beer was a felony?
How about Alcohol Paraphernalia? If you had a cork from a wine bottle.. would you be arrested and thrown in State Prison for 2 years?

How about property forfeiture? If you had a six-pack,, that meant they could auction off your house and your car because it was used in the commission of a "felony"......

12. Actually, the XVIII Amendment only
made the manufacture, transportation or selling of alcoholic beverages illegal, not the consumption of same. Believe the Volstead act was worded in the same manner. It was not a felony to drink booze, only to make it, carry it, or sell it.
