... Presidential records, both of the current President (Obama) and any former President, living or dead, has come to an end. A far more limited and specific exercise of such claims is required and is subject to challenge and reversal.

Think "Energy Task Force."
Think Iran/Contra during Bush41.
Think Reagan papers blocked by Bush41 or Bush43.

The (current) Attorney General may, possibly together with the Counsel to the (current) President, determine no justification for a claim of executive privilege with respect to the public disclosure (by the Archivist) of Presidential records (which are, by definition, in the care of the Archivist due to their age and inactive status). In short, there is now a DUE PROCESS whereby the justification for such a block can be assessed.

the media should have a fucking field day with this and go after some of bush's shit--especially after what russell tice said tonight on olbermann--that the media was getting spied on big time by the nsa--from their phones to computers to faxes!

Sec. 4. Claim of Executive Privilege by Former President.

(a) Upon receipt of a claim of executive privilege by a living former President, the Archivist shall consult with the Attorney General (through the Assistant Attorney General for the Office of Legal Counsel), the Counsel to the President, and such other executive agencies as the Archivist deems appropriate concerning the Archivist's determination as to whether to honor the former President's claim of privilege or instead to disclose the Presidential records notwithstanding the claim of privilege. Any determination under section 3 of this order that executive privilege shall not be invoked by the incumbent President shall not prejudice the Archivist's determination with respect to the former President's claim of privilege.

(b) In making the determination referred to in subsection (a) of this section, the Archivist shall abide by any instructions given him by the incumbent President or his designee unless otherwise directed by a final court order. The Archivist shall notify the incumbent and former Presidents of his determination at least 30 days prior to disclosure of the Presidential records, unless a shorter time period is required in the circumstances set forth in section 1270.44 of the NARA regulations. Copies of the notice for the incumbent President shall be delivered to the President (through the Counsel to the President) and the Attorney General (through the Assistant Attorney General for the Office of Legal Counsel). The copy of the notice for the former President shall be delivered to the former President or his designated representative.

21. The part about the court order I think is also of interest,
I haven't read Bush's EO for a long while and wonder if this too is a revocation of part of that initial EO.

I wonder how Bush will be able to push off national security interests for his executive privilege claims?

Executive Order 13233 limited access to the records of former United States Presidents. It was drafted by then White House Counsel Alberto Gonzales and issued by President George W. Bush on November 1, 2001. Section 13 of Order 13233 revoked Executive Order 12667 which was issued by Ronald Reagan on January 18, 1989.

The Order was partially struck down in October 2007, and President Barack Obama completely revoked it by executive order on January 21, 2009, his first full day in office. However, as long as no bill is passed by Congress with regards to this issue, any future president is free to issue yet another order to take the place of the revoked order 13233, just as Order 13233 revoked Order 12667.
