When the Senate and House Judiciary Committees start looking into the political interference with the Foreign Corrupt Practices Act investigations against Halliburton, we'll be moving into endgame.

We entered into various agreements relating to the separation of KBR from us, including, among others, a master separation agreement, a registration rights agreement, a tax sharing agreement, transition services agreements, and an employee matters agreement. The master separation agreement provides for, among other things, KBR’s responsibility for liabilities related to its business and Halliburton’s responsibility for liabilities unrelated to KBR’s business. Halliburton provided indemnification in favor of KBR under the master separation agreement for contingent liabilities, including Halliburton’s indemnification of KBR and any of its greater than 50%-owned subsidiaries as of November 20, 2006, the date of the master separation agreement, for:

- fines or other monetary penalties or direct monetary damages, including disgorgement, as a result of a claim made or assessed by a governmental authority in the United States, the United Kingdom, France, Nigeria, Switzerland and/or Algeria, or a settlement thereof, related to alleged or actual violations occurring prior to November 20, 2006 of the United States Foreign Corrupt Practices Act (FCPA) or particular, analogous applicable foreign statutes, laws, rules and regulations in connection with current investigations, including with respect to the construction and subsequent expansion by TSKJ of a natural gas liquefaction complex and related facilities at Bonny Island in Rivers State, Nigeria

Halliburton to Dubai except for a token part that stays here? What part of Halliburton is covered by the Deleware registration (licensing or whatever the term is that covers culpability within the U.S.)?

Does it all mean that if a soldier or his family or employees wanted to file a lawsuit or if our Congress wanted an investigation - we would have to hire a Dubai lawyer?

5. How Can the DOJ/Treasury Credibly Freeze Iranian Assets If...

... they cannot bring an FCPA investigation to conclusion involving a politically-connected Houston-based company?

In other words, if they cannot untangle an American company's finances to "follow the money" on a foreign bribe, how can they credibly assure the American people that they can enforce sanctions against Iran?

Maybe the answer lies in the amount of actual political will to do each task.

sometimes I seriously worry about his blood pressure. I'm awfully happy, however, to be represented by him. Always have been. He's an anti-corruption force, and he's not owned wholly or in part, big oil, AIPAC, big Pharma, or anyone but us Vermonters.
