1. I'm going to ask this as a devil's advocate. Having said that...

WHY would this waive executive privilege? Why? In what sense are these e-mails not deliberations by Bush's staff pertaining to matters political and policy concerning which they are expected to advise the President? In what sense are they not meant to be protected as candid advice, reached individually and collectively?

I think that storing the e-mails this way violates the records retention law, but I don't think that the e-mails being stored or transmitted in violation of binding policy, somehow makes them not executive anymore, if they are the President's business.

It would be like saying that just because a dossier is found in a trash can means it's not classified anymore, because it is in a trash can, and not in the possession of the government.

For several reasons. Most importantly, that the servers they use are secure (ha ha) and that we don't have Watergate deux.

4. I don't see what the one rule has with the other.

I see one rule broken as all hell, but I don't see that having anything to do with weakening (or strengthening for that matter) an executive privilege claim.

7. I'd argue that national security includes the branches of

government as well as the buildings of government. If Bush as a target is a national security issue, than so is the federal court system or the legislative branch.

8. do you know the ENTIRE scope of the emails they did

off the .gov server? Doubt it.
