msnbcCINCINNATI - A federal appeals court in Ohio has once again opened the way for the Justice Department to deport alleged Nazi death camp guard John Demjanjuk.
Friday's ruling denied a stay of deportation for the 89-year-old retired autoworker from his suburban Cleveland home. It could be appealed.
An arrest warrant in Munich alleges he was a guard in Nazi-occupied Poland in 1943.
His family said he was too old and sick to be sent to Germany. But, the government filed a video last week showing Demjanjuk walking on his own.
Demjanjuk's lawyer said Demjanjuk may be able to walk a few steps unassisted but that medical evidence shows arrest, incarceration and trial would cause severe pain.
Demjanjuk, a native Ukrainian, has denied being a Nazi guard and claims he was a prisoner of war of the Germans. He came to the United States after the war as a refugee.
