Glenn Beck, Dobbs, Limbaugh and now Tancredo.....


The Republican Party is devoid of anything resembling a conscience. It is intellectually and morally bankrupt - completely. Sad and pathetic.

5. The problem with Sotomayor
is her opinion in Walczyk v. Rio.

Within this opinion Sotomayor clearly indicates that the only protection an individual has against his civil rights being violated by the police force is the limited understanding of those constitutional liberties by the arresting officer. If a "reasonable officer" would believe that his actions were legal under the circumstances then that officer is "immune" from prosecution and civil liability. Furthermore, any evidence gathered or arrest made during the action, rather constitutional or not, can be used as evidence and the arrest can stand.

Now, from this ruling one can easily see that in Sotomayor's legal view, a military individual waterboarding an enemy combantant is completely free from prosecution as long as any "reasonable soldier" would believe that the actions were legal. But worse, any "evidence" gathered during the waterboarding would be completely admissable in court.

Abortion, gay rights, judicial revisionism--they all "smoke screens". The real hurry to confirm Sotomayor lies in the docket of the upcoming Supreme Court, and the hearing of several cases involving criminal enforcement and investigation. A Sotomayor justice is just another step toward the police state.

The portion of the majority's qualified immunity discussion that I find objectionable reads as follows: "If the right at issue was not clearly established by then existing precedent, then qualified immunity shields the defendant. Even if the right at issue was clearly established in certain respects, however, an officer is still entitled to qualified immunity if `officers of reasonable competence could disagree' on the legality of the action at issue in its particular factual context."
