I hope that Prop 8/ Gay Marriage goes to the Supreme Court

the fact that Ted Olson, a strong conservative, favors gay marriage gives me hope that even on the U.S. Supreme Court we could get a majority in favor. If I had to guess the most likely Justices to support it would be:

Stevens
Ginsberg
Beyer

If Olson supports gay marriage I think that there may be some hope that Kennedy, Roberts and Alito may utlimately come out in favor too.

What about Judge Sotomayer? I think she would come out for gay marriage as well.

Just my two-cents.

1. I think Alito and Roberts will be solidly in the "anti" column.

Sotomayor will be "pro."

It's all about Kennedy. I think he is persuadable. But right now my best guess is that he is anti.

5. Kennedy wrote the decision in Lawrence

which actually foretells, in part, an eventual marriage decision.

Scalia, in his dissent, accuses Kennedy of laying the groundwork for striking down anti marriage laws nationwide.

I believe Kennedy will write the decision.

and lawrence is important at least to olson.

i don't understand why we're not talking about people past the age of reproduction - why do we confer all the benefits of marriage on them?

6. I would think the vote would depend on exactly what question

was put before the Court. If the question is similar to the one that made it to the California court ie., is it legal to change the state constitution via a referendum, I could see a decision confirming the Cal Supreme Court decision. If the question address specifically the inequality of a law denying gays the right to marry, I think the decision would be in favor gay rights.
