Jan Brewer and state officials violated the state Constitution earlier this year when they took money from an early-childhood-education fund to help balance the state budget.
That fund, known as First Things First, was created by state voters in 2006 with their passage of a ballot proposal that increased tobacco taxes to fund a variety of education and health programs for children.
In January, with the state facing a $1.6 billion budget shortfall for fiscal 2009, Brewer and legislators moved $7 million from the First Things First account into the state general fund. State officials argued that the money, interest that had accrued off the special account's tax revenue, was exempt from protections that guard voter-approved measures.
The state Supreme Court ruled otherwise Friday and ordered the $7 million returned to First Things First.
