i keep seeing all these posts about what the police "would have done" if it wasn't tiger . it was a frigging car accident. he has no duty to give a statement, just his info (license, reg, etc.). there is no PC for DUI, so they wouldn't "test" for it.
i've had cases like this, with complete nobodies, and the same thing happens. cops write up the report with the info they have. they can't compel a statement, and they can only arrest/test for DUI if there is PC for dui. there were (apparently) no liquor bottles at the scene, and nobody who is saying he smelled of alcohol or was acting drunk, so all they have is an ACCIDENT, which is a civil matter.
it's pretty common when drunks crash their car for them to run from the scene. even if we find them later at their house, we can't prove they were impaired WHEN they crashed the car, so it's a basic report. i had one guy invite me inside and show me the half empty bottle of vodka he claimed he drank AFTER the crash because he was depressed. he was even holding a glass of vodka in his hand. he and i both knew he was full of shit, and we both knew there was nothing i could do about it. it was actually kind of funny.
if tiger had hit another car and taken off before giving info to the other driver, he could be charged with a (minor) crime, but as it is, it's just a one car collision, civil matter.
i can think of two cases off the top of my head exactly like this. and they were complete nobodies. nobody was arrested.
