Seriously. How is it that Porn is legal, but prostitution is not? I don't get it.

Seriously. How is it that Porn is legal, but prostitution is not? I don't get it.
I mean, are you not paying the actors to have sex?

And if not - if you claim you are just paying them to act - then as long as you videotape it and call them actors, can't you effectively get around all the prostitution laws by claiming you were making a movie?

Yes, of course, there are pimps. But, traditionally, the woman was making her own money.

I am currently reading the book SUPERFREAKONOMICS, written by the guys who wrote FREAKONOMICS, and they have a whole chapter about the incentives of prostitutions. It turns out it is actually better for prostitutes to work under a pimp. The pimp provides all sorts of valuable services, such as lessening the chance of violent encounters, seeking out a better class of clientelle, and even though the pimps take a cut of the money, prostitutes working under pimps average making more money. Pretty interesting reading.

I've known so many women over the years who financially supported their deadbeat husbands or boyfriends. Almost all of the strippers I worked with had boyfriends who were mooches. They were usually hot and artistic, but mooches, nonetheless.

It's crazy that men would still think this way in 2009.

I used to pay a lot on dates when I was in college, because I was financially secure and my dates were usually starving students. It just seemed like the right thing to do. I had no expectations about it. It's dumb to expect sex from someone exchange for a meal or movie ticket. And why would a man like thinking that a girl is only fucking him because he bought her dinner? How bad does your self-esteem have to be that you would get off on that kind of thing?

I don't see how prostitution is illegal. I really don't. Logically it makes no sense to me, but I guess for me morally, I don't like it. So, while I can't understand why it is illegal, it doesn't make me too upset.

everyone should be able to get behind legalization even without supporting the habit itself per se. I mean, just think of the tax money we could raise and save by legalizing both those things, no one outside those involved are "harmed" by any definition of the word. We could cut taxes and still take care of the deficit. It's insane not to.

But I guess there's an entrenched notion that legalizing it would bring about the end of the world somehow.

I wish I had the details hand.

At one time production of porn was criminalized under anti-prostitution laws.

From my recollection, there was a prosecution, conviction and appeal. The appeal was successfull and the conviction was thrown out on 1st amendment principles setting the precedent of making porn legal to produce.

California v. Freeman was the criminal prosecution of Harold Freeman, a producer and director of pornographic films, by the U.S. state of California. Freeman was arrested in 1987 for hiring adult actors, which the prosecution interpreted as pimping, as part of an attempt by California to shut down the pornographic film industry. The prosecution's interpretation was ultimately rejected on appeal by the California Supreme Court. Prior to this decision, pornographic movies had often been shot in secret locations.

Freeman was initially convicted, and lost on appeal to the California Court of Appeal. The trial judge, however, thought jail would be an unreasonably harsh penalty for Freeman's conduct, and sentenced him to probation, despite the fact that this was explicitly contrary to the statute. The State appealed this sentence but lost.

Freeman appealed to the California Supreme Court, which subsequently overturned his conviction, finding that the California pandering statute was not intended to cover the hiring of actors who would be engaging in sexually explicit but non-obscene performances. Freeman could only have been lawfully convicted of pandering if he had paid the actors for the purpose of sexually gratifying himself or the actors. The court relied upon the language of the statute for this interpretation, as well as the need to avoid a conflict with the First Amendment right to free speech. The court viewed Freeman's conviction as "a somewhat transparent attempt at an 'end run' around the First Amendment and the state obscenity laws."

52. For a lot of reasons.
Porn is pretty highly regulated. The people that do it legally follow pretty strict guidelines. They can only film in certain areas that expressly permit it. The actors are all over the age of 18. They are all tested for STDs. The actor isn't the one paying the actress, or vice versa. And, numerous other regulations that I won't get into.

The act might be close to the same, but there is a world of legal difference.

Also not to beat a dead horse but how are tobacco and alcohol legal but weed isn't? I mean tobacco and alcohol can kill you and are addictive, both affect your consciousness in some way or another. Alcohol can make you so drunk you black out not remembering anything that happened the night before. Yet weed just makes you relaxed, happy and hungry with no death.

65. There have been cases
Because of California v Freeman it's legal to film porn in the state of California, in a certain county. As far as I know, while prostitution/pandering cases have been brought against pornographers outside of California, those charges were dropped for guilty pleas on other charges and/or fines paid.

trouble.

It is NOT illegal to film someone kissing and fondling a topless actress (a la racy Hollywood films) and pay them.
It IS illegal to pay to kiss and fondle a topless woman.

Is this logical? Meh.

A lot of porn sites have essentially become prostitution sites, with people paying to do things to under people under the guise of pornography.

I always wondered how this worked.
