5 Years Later, Woman Admits To Gang Rape Hoax-Man in Jail not laughing


A woman who claimed to have been gang-raped five years ago pleaded guilty in Manhattan Monday to perjury charges in connection with a case that put an innocent man behind bars for several years.

Biurny Peguero, 27, first told her story in May to a priest at St. Anthony of Padua Roman Catholic Church near her home in Union City, N.J. The priest helped her contact an attorney who brought the case to the Manhattan DA's office. As a result of her new testimony William McCaffery, the man convicted of raping her in 2005, was released from prison and is now awaiting final dismissal of the charges.

Peguero's Attorney, Paul Callon, called it "an awful situation of someone telling a lie, then being locked in the lie as the system proceeded."

The lie happened after a long night of heavy drinking at the Umbrella Lounge in Inwood and it wasn't rape. It wasn't even sex.

Peguero could get seven years in prison for what she's admitted to. She could also be deported. A native of the Dominican Republic, she is a legal resident who came to the U.S. 13 years ago. She is married to a U.S. citizen and has two children who were born here. One is 7; the other is an infant who was born in November.

McCaffrey is currently out of prison on bail and is scheduled to go before a judge on Thursday, where the criminal case against him is expected to be dropped.

1. I don't get it......
gang rapes generally involve more than one perpetrator, yet only one man was convicted? Let me add... I feel bad for all concerned, it had to be hell for the man to sit in prison for 4 years labeled a rapist...and horribly hard for the so called victim to own up to her lies, as she could have taken them to her grave....at least she righted her wrong.

by giving that man his years back...and that won't happen. she deserves prison and then deportation...

I completely agree, i didn't mean to imply she should she walk free. She needs to pay for her lies, however no matter what punishment she gets it will not give this man back the years he lost.

5. How the heck did that guy get convicted?
When the rape kit came back negative? Did she lie in court?

Why would somebody do that to somebody else (lie about being raped), and waste their own time testifying in court after a night of something so trivial for something that didn't happen? By lying, she is hurting real rape victims who want to be believed.

6. I don't get that either
She left with 3 men and said they all raped her but only the one got convicted? How was that one guy singled out and there was no testimony about her physical injuries being the result of the fist fight she got into after the fact?

I don't get it.

9. yup
She needs to do the time AND she shouldn't be allowed to stay in this country. Just deporting her isn't anything close to being good enough. If she were a US citizen she'd have to do the time since there would be no deportation option.

It's nice that she finally did own up to it though knowing what the penalties she would face would be and knowing that just continuing to live with the lie she'd skate. I can't help but wonder though if something else may have prompted her sudden admission.
