Is Obama afraid of BushCheney and their moles?

Why doesn't the President call Cheney and say, "Dick, we would appreciate it if you would STFU. We have documented your involvement in various operations whose disclosure would be very embarassing to you." (With the underlying message that there would be criminal prosecution.)

I just don't get it.
