Was watching a show on the Discovery Channel and a woman said she could not have in vitro fertilization to get pregnant because she worked in a Catholic school, and had signed a "Cardinal Clause". She said that she would get fired if she used any kind of artificial means of getting pregnant.

But there is another part of the plaintiff's case that is less implausible. Mr. Neuberger claims that Ursuline is not entitled to the religious exemption from nondiscrimination statutes because it is not religious enough. He notes that the school is independent of the diocese; it hires non-Catholics; and it doesn't offer employment contracts with a "cardinal's clause." Such a clause, not uncommon in the workings of religious schools, would mandate that teachers avoid taking a public stance against the church's teachings.

Additionally, if those present as witnesses to the event serve in ministry in the church — as teachers, administrators, catechists, chaplains, etc. — they will be deemed to be in violation of the Cardinal’s Clause and/or the Code of Pastoral Conduct. As such, the most serious consequence would be dismissal from ministry and/or loss of employment.

Non-Catholic teacher brought Title VII action against Catholic school after it failed to renew her contract because of her remarriage. The United States District Court for the Western District of Pennsylvania, Alan N. Bloch, J., 739 F.Supp. 1003, entered summary judgment in favor of school, and teacher appealed. The Court of Appeals, Stapleton, Circuit Judge, held that Title VII did not apply to school's decision.
