Question On Med Marijuana RX (NJ Voting Today)

Let's say it passes in NJ. I live in NJ but my Dr. is in NYC. Could I get an RX from him for it or does the Dr. need to be in NJ?

1. It depends on how the law is written
but offhand I'd say that prescribing physicians will be limited by the state which passes the law. You might need to have a local doc to get medical grass.

2. My understanding: there is NO "Medical Marijuana Prescription"
The classification of drugs is regulated by the Federal government, which recognizes no medical usage for cannabis. Therefore, doctors may give "recommendations" to their patients under various state med. mar. statutes that sanction the use, possession, and sometimes cultivation of the stuff under state law.

But as it stands, doctors may not prescribe pot, nor may pharmacists dispense pot, for much the same reason.

All that said, some state statutes have provisions to honor out of state "recommendations". I believe Michigan's does...

6. So You Get A "Reccomendation"?
and then have to bring that to a dispensary? I assume pharmacies wouldn't be distributing...Or does it depend on the actual law?

7. No dispensaries here in Michigan. You have to register a "caregiver"

to grow for you, or else grow the stuff yourself.

The law isn't entirely realistic on this point, I must say.

This will all vary from state to state, naturally.

3. Doctors don't really write official prescriptions, they make recomendations to get around AMA rules.
Since official prescriptions are allowed to be filled across state lines, recommendations ought to be the same.

4. I don't know about New Jersey. In California,
you must be a resident of the state to participate in the program.

10. I think you'll need a doctor in your state.. but..
at many dispensaries they have doctors on call or on site to give you the "authorization". In Colorado you can go to some dispensaries and get the paper from the doctor right there and then, send it in and get your card mailed to you.

I haven't done it yet but a couple of friends have. I don't really need it for medical use but I may get it anyway just to keep from getting busted if I get caught with a bit of weed...

12. Please don't get a script just to go get high. I have had to risk my freedom helping sick people....
....many times in the last 15 years.



You would be surprised by how few dealers are willing to sell to a person in a wheelchair even if that person could easily travel to the dealer in the winter. "I don't want your fuckin' ramp van parked in front of my house."

I have had to be "human roach clips" for people who can't move their hands enough to roll a joint or even hold it to their own lips.

I have had to make Vaporizers and Edibles for people who were on oxygen and risking blowing their house to kingdom come by smoking medicinals. Just the act of making a Vaporizer for a dying (now dead) cancer patient could have landed me in jail. I was very lucky a relative cleaned up the cancer patient's stash and paraphernalia before the authorities came to take his body when he died.

There are people who stuck out their necks for suffering and dying people and faced a LOT more jail time than what you face as a casual consumer.

Please don't make light of that.

13. Don't put prohibition on the shoulders of either users nor dealers. Not their fault. Not at all.
It's YOUR government (and mine) that does this. Not some dude selling dimes to pay his rent.

9. NOT AMA rules, DEA rules.
The DEA controls who can write prescriptions. It threatens to take away that right from any doctor who writes prescriptions for medical marijuana. So, the medical marijuana states get around that by allowing patients to use marijuana with a doctor's recommendation, not a formal prescription.

I am almost certain it will have to be a doctor in your state who recommends for you.

8. Here's how it works in California
Doctor writes a recommendation or completes a form that is available on-line. Some dispensaries will accept the doctor's letter alone. The official policy is that you apply for a county or state card at a facility set up by the county (at least that's how it is done in Alameda County). The county card is usually accepted in other counties, but the state card is accepted everywhere. The county card is much cheaper than the state card which costs around $100. Cards are valid for one year. A non-patient caregiver may also apply for a card at the same time as a patient and must pay the same fees. The caregiver may then procure for the patient.

It restricts doctors from prescribing marijuana for anything less than a terminal illness or debilitating condition, such as cancer, AIDS or multiple sclerosis.

Patients will not be allowed to grow their own supply and sales of medical marijuana will be tracked by the same regulatory framework used with powerful opiates like OxyContin.


Instead of allowing private pot shops that limit their customers to those with a prescription, New Jersey will establish six non-profit marijuana growing operations that do not purchase their supply from elsewhere.

I hope this will be a whole lot better than the Govt weed they froze in 1977 and doled out for a few decades.
