Reposession agent takes away a woman's car - with her two-year-old son sleeping in the back seat

Right now a lot of Americans are struggling to keep their houses, cars, whatnot property in this economic recession.

Because one woman from San Jose, Isabel Leuvano, was 17 days late on a car payment, a repossession agent drove her car away while she was picking up her daughter...even though her son was still sleeping in the back seat! This is her story.

On Tuesday night, the repo man came.

Trouble was, when he snatched back her 2000 Honda Accord, her 2-year-old son, Cyrus Lopez, was repossessed, too. He was asleep in the back seat.

Frantic, Leuvano called 911. She thought the car — and her child — had been stolen right before her eyes as she stepped outside to pick up her 6-year-old daughter.

Police swarmed to her rescue. A search helicopter circled the air.

And 31 minutes later, San Jose Police found the boy after astutely figuring out to call Alberto's Auto Sales on East Santa Clara Street to discover that little Cyrus was in the lobby, his eyelashes stuck together in clumps because he had been crying so hard.

"It was a nightmare," Leuvano told the Mercury News. "I thought I was losing my mind. I kept thinking, 'Who hates me enough to take my son?' I was freaking out."

I am hardly a proponent of lawsuits but this situation merits one.

The repo man didn't notice the screaming kid in the back of the car?

3. He did not follow the law, according to his own statement to police

"Luna acknowledged he failed to check the vehicle identification number on the car before taking it as required by law, but he said he was "sure" it was the right car."

What if it had been the wrong car with some completely uninvolved mother's child? I'd bet he would have abandoned the car and not felt one bit of remorse. And when he realized he had the kid, did he call the police? According to the story, he did not. Nail the bastard for pain and suffering.

It's not illegal to exit your car when there are children in it.

Of course, children have died because parents didn't leave the care running with the A/C on when they accidentally locked them in.

We have a shitload of stupid laws in this country. The Law can't address every damn thing in black and white.

..but I have one problem with mom's account.. if she really was standing next to her car when the repo guy jumped in, she would have shouted that her child was in the back, wouldn't she have? ..and what repo guy wouldn't at least check to verify, at that point? I'm wondering if mom was in fact on the porch, or even in the house, while her sleeping child was alone and out of eyeshot, in the back of a running car.. if that's the case, that woman is lucky that it was a repo man and not just car thieves who jumped in to her car and drove away.

..doesn't excuse the repo 'agents', but mom wasn't exactly on the ball either.
