Alliance Defense Fund (ADF) attorneys are preparing this week to appeal a Superior Court decision that bars Washington, DC, residents from the right to vote on marriage.
Last year the DC Council passed a law legalizing homosexual "marriage," which prompted a citizen referendum calling on the Council to take the issue to the voters. The Council, its election panel, and now the courts have denied the request. ADF attorney Tim Tracey tells OneNewsNow that that decision is wrong.
"The DC charter, which outside the U.S. Constitution is the supreme law of the District of Columbia, provides the people the right of initiative, the right to initiate legislation, and the right to say (they) want to vote on the issue of marriage," Tracy explains.
The Council and the courts have stated that allowing the people to vote on homosexual marriage would violate the district's anti-discrimination laws -- an argument that Tracy finds somewhat surprising.
"The cry from the other side in these cases is always, 'This is about civil rights. This is about discrimination,' but, the fundamental right at issue here is the people's right to vote," the ADF attorney argues. "That's the civil right at issue and the DC government is just jettisoning that right to try to push through its agenda."
Tracey points out a bit of irony -- the District of Columbia is supposed to be the seat of democracy for the world.
