How We Can Revoke Corporate Personhood (a DU must Read)
once again for the Saturday crew.........

How We Can Revoke Corporate Personhood

Corporate personhood and corporate constitutional rights are a lie. How do we get the courts and government to realize that?

The simple solution would be to somehow bring a case involving only corporate personhood to the Supreme Court and ask them to rule on it. Hopefully they would take a strict-constructionist line and recognize that the Constitution does not mean corporations when it says persons. This method is unlikely for a variety of reasons, the foremost being that the current Supreme Court is a product of the corporate-dominated legal system and appointees are designated by corporate-dominated presidents and approved by a corporate-dominated Congress. In addition, many roadblocks have been built into the system to prevent such a case from even coming to the Supreme Court. We would need a law in some State or locality specifically denying corporations personhood, but attorneys and judges have so far taken the view that any such law would be outside the allowable bounds for local jurisdictions. They can (and certainly will) advise elected officials that they cannot even allow such a law to come up for a vote or referendum.

But neither did the railroad attorneys simply declare corporations persons and a few days later have the Supreme Court agree with them. Powerful as they were, it took them 15 years to get corporate personhood enshrined in the system.

We will need a sustained grassroots campaign to abolish corporate personhood. This campaign has barely begun. We can win with education and action. We must try to pass laws abolishing corporate personhood in every local government and in every state. We must argue before the courts so that they become familiar with our ideas. We must pass referenda and then protest when our referenda are struck down by the corrupt judiciary. We must demand that elected representatives take a stand against corporate personhood if they want the votes of environmentalists, workers, and small business owners. And we must argue our points in the law schools where future generations of lawyers and judges are being trained.

3. We also need to find someone else to build our voting machines and eliminate Republican
Edited on Sat Jan-23-10 12:53 PM by peacetalksforall
TV networks and papers from the exclusive hold they have on polling and calling the votes. We need to get non-corporate coverage of our candidates.

> New machines or one new machine and get our counties or State to change to it.
> Process polling and calling on our own.
> Get better coverage - and use legal proceedings to get it
> Educate

EDUCATE OTHERS ABOUT WHAT IS GOING ON AND GET THEM INVOLVED - FOR THE GOOD OF ALL GOOD PEOPLE.

4. I don't think Americans realize Corp-Personhood exist by law
FreepTards are oblivious to the fact and given the current state of the economy and many Unemployed Americans angst at the Wall St. Corporations for sinking the World Economy there would be much if any Public Opposition to wards overturning the original decision granting corporations the rights of a person.

In fact Public outcry should and could very well carry over into limiting Corporate control in "Forumalating What is News" worthy of airing over Public Air Waves

8. I posted this in another thread. I believe that Republicans can't help but learn
Edited on Sat Jan-23-10 01:43 PM by peacetalksforall
who the true enemy is.

"I've been saying for years - our real enemy is the corporations. They declared war on us a long time ago. Once we realize this, things are going to make more sense. The war in this country is not Republican against Democrat. The pivot point in the way this has evolved is Congress. It has been easier and easier to sort out their lies and hypocrasies and observe how they do not stand up for us. They vote for the war industry, for the torture industry, for the spying on us industry, for privatization. They are 100% enablers for lobbyists. They have choices when they host and say yes to lobbyists - some are lobbying for us - but, we know the damage they do to us when they allow wealth accumulation for nasty, polluting, financial, and death and maiming war profiting decisions.

Congress is allowing the war on US.

Republicans and Democrats do not know how adept Congress is at aiding and abetting the corporate enemy who are out to destroy us by making us serfs who are/will be totally controlled. All serfs will be accounted for every minute of their existence. Protest will not be allowed. All indicators are present. It will be obvious to more that votes don't count because our Constitution and Bill of Rights have already been rewritten and are slowly being put in place. They will be announced and declared formally at a later date, All the clues and evidence are present. It includes religious devotion (with a tendency to hysterical rather then personal or supplemental) leading to religious rule.

The war is NOT between Democrats and Republicans.

The corporations/barons are out to own and rule. It's up to us to know it. And now it's easier. The make-up of this Court is no accident."

6. Utter nonsense in the context of the first amendment
Groups such as the ACLU, NYT, LAT, and other corps have the right to free speech. Why such unwarranted wailing and gnashing of teeth when the decision was limited to the First Amendment?

7. Your wrong - it opens the door to abuse of our Corporate Laws
ACLU, NYT, LAT are in business to stay in business

Groups such as Citezens United can be formed and disolved at will for the sole purpose of Slandering a Candidate with no civil penalties for the persons who formed them

14. Absurd argument. There are so many things wrong with it, I don't know where to begin.
What, you only have a right to free speech if there are "civil penalties" associated with slander? Whether they're incorporated or not, there are, in fact, several civil penalties that exist.

18. Then enlighten us - Incorporating protect your private assets
I'm sure there are some that would like to claim "Nothing to see here folks" but I'm not one to buy into that school of thought.

Look how well it protected Enron Energy Traders when they manipulated the Energy Prices in California - NOT 1 WAS EVER PROSECUTED even though taped conversations with the Energy Traders was turned over to the Government.

What Key Lay and assoc. were successfully prosecuted for was Fraud on their Earnings Reports which was proven by the records turned over to the accounting firm.

But thanks for playing any way

As some one noted last night, it does have the DEMs in the house and Senate united for a change. At least they recognize the severity of the possible consequences to this decision.

22. We could form a Corp to expose Limbaugh's homosexuality
Some one from his college days came forth and admitted to a relationship with Rush.

The story was hushed up pretty quickly.

We could Jam it over the airwaves pretty cheaply and "so what" if they sue the Corporation in Civil Court. Won't effect us any and the Corp will be bankrupt and dissolved long before that

Of course, it will also help to stop patronizing the corporations who are the most egregious offenders.
And do it loudly.
No profits?
No money to use to slander their opposition.
Do it loudly!

13. Difficult, but not impossible.
Turn down the thermostat, put on a sweater.
Don't drive unless absolutely necessary, combine trips.
Use cash, don't borrow their money to buy stuff you probably don't need anyway, and then pay them interest for the privilege.
Every little bit helps.
Starve the beast...

...and I have no intention of leaving.
I do, however, intend to stop feeding the beast as much as I possibly can.
As it is, they make very little profit from me.
It's a matter of making sure they get even less.

It's not about teaching them anything.
It's about limiting their influence...

23. Actually, treating corporate person like the other persons would do the trick....
Thinking outside the box. New amendments take time and can be corrupted. We need a solution now. Our own shock doctrine

Since the USSC reconfirmed corporations are persons, they (corporate people) must follow the same rules of all other persons.

When a person goes outside the law, criminal law is used to against them. All persons (corporate or other) must follow the law.

For example:

A Person cannot own slaves. So a corporation (a person) cannot own another corporation (a person). Those corporations (a person) the currently own a slave (another corporation, a person) have violated the law. These slave corporations (a person) must be set free immediately with no repercussions or debt. The corporations (a person) that owned the slave corporation (a person) should then be arrested. The anti-slavery laws have been in place for a long time, Ignorance of the law is no excuse.

A Person cannot break into person’s house and vandalize it. There was a case recently about BofA foreclosing the wrong house, busting into the house, changing the locks, and turning off the electricity causing the refrigerated items to spoil. The law is very plain for burglary, breaking and entering in every state. So BofA (a person) should be arrested and put on trial.

Feel free to add your own.

Note: as has been said elsewhere a corporate person is a group of people. So when a corporate person is arrested it would include everyone from that group: employee, owner and stockholder. Since they are a single entity, only the entire group could make bail. Otherwise, we could go rob Bank of America banks until we were caught and just say our toenail did it and while our toenail is in jail, the rest of our bodies would be free.

This would allow us to act now, this second. And put the fear of god finally where it needs to be. And allow time to put together a public election financing bill/ammendment.

If the corporate persons resist, we can address the fact that, if corporations are a person, all corporate law is illegal being a Bill of Attainder against the American people. The American people were singled out for punishment (and not given a trial) by the legislature when they were denied the special protection from liability for their actions that were given to the Corporate person(s). Then since corporate law is illegal, all contracts created by corporate persons are void.
