State Sen. Roy Ashburn, R-Bakersfield, was arrested early Wednesday on suspicion of driving under the influence of alcohol, according to the California Highway Patrol.
Ashburn and his spokesman could not immediately be reached for comment.
Ashburn was spotted weaving in downtown Sacramento at about 2 a.m. and was pulled over, said Sgt. Rick Campbell of the CHP in Sacramento.
He had bloodshot, watery eyes and smelled of alcohol, Campbell said, and completed a field sobriety test at the scene, Campbell said. He said Ashburn was determined to be under the influence of alcohol and arrested on misdemeanor charges at 2:10 a.m.
