I'm no certain, but I would imagine that Virginia has some kind of mandated auto insurance law as well as accepts Federal money through taxes raised from "mandated" payroll taxes. Yep, let's see him try to take this to court with hopes the Scalia 5 will come to the rescue.

His real game here is to make a name for himself...become the next "darling" of the wingnut party so he can run against Webb in a couple years.
