Republican threatens filibuster if next Supreme Court nominee stands up ‘for the little guy’

By David Edwards and Gavin Dahl
Sunday, April 4th, 2010 -- 10:53 am

There is not yet a vacancy on the Supreme Court but the second-ranking Republican in the Senate is already planning a strategy of opposing President Barack Obama's potential nominee.

Jon Kyl (R-Az) told Fox News' Chris Wallace that Republicans are prepared to fight a nominee who might stick up for the little guy, a position he called "overly ideological."

Kyl had decried the use of the filibuster when Republicans were in the majority. "It's never been the case until the last two years that a minority could dictate to the majority what they could do," Kyl said in 2005.

Since Democrats were the first party in decades to use the filibuster to block a judicial nominee, Republicans are within their rights to continue to use it, according to Kyl. Democrats blocked George W. Bush's nominee, Miguel Estrada in 2001.

1. 99% of America is the "little guy".
A Supreme Court nominee who will stick up for us is the only kind we can afford. The Republican Party needs to get out of history's way and let the country finally move forward again.

5. But they almost had strokes when the democrats even questioned
Alito and Roberts before they were confirmed. SO they can stop democrat appointees but you don't dare even ask a republican appointee a question.

The last thing this country needs is a right-wing SCOTUS.

It's amazing to me that they think they are in charge and dictate that President Obama nominate a Republican Corportist to the bench. The gal of these people is just unbelievable.

12. Make Kyl into an unemployed, little guy, quick!
Let him experience the same problems most of the world suffers through with his (socialist) medical plan, (socialist) unemployment checks (if they ever start again) and (socialist) welfare payments.

He'll soon be extolling the virtues of the large life again.

14. Well, they never stopped Sotomayor
And she definitely isn't a fan of overreaching federal power or corporate legal immunity.

So go ahead and try to filibuster, Kyl. The country is getting tired of YOUR ideologues, not Obama's.

17. Hypocritical bastards.
There's about three or four GOPpers who would have hell to pay if they filibustered a SCOTUS nominee, though.

21. If only SCOTUS would stand up for the little guy ...Kelo and Raich come readily to mind.
More and more the little guy gets screwed from right and left.

In Citizens United v. FEC much was said about the right wing's over reach protecting corporate speech, but had the dissenters prevailed, we who are not part of the institutional press might have found ourselves lacking protection of the Freedom of the Press. The littel guy was to get screwed either way in that case.

In Heller, SCOTUS came within one vote from stripping us of our RKBA based on a truly kooky theory that was rejected out of hand just a few years prior in Silveira.

One can only hope Stevens' replacement will stand up for the little guy, because far too often, he did not.

25. that is an awful title. Rawstory and others are spinning
apparently trying to generate more partisan rancor. Apparently anything somebody says needs to be taken in the most divisive and confrontational interpretation.

For one thing Kyl did not 'threaten'. He did not come out and make a statement like "I am gonna filibuster the next Supreme Court nominee."

Nor did he say anything about how "I am planning a strategy of opposing President Obama's potential nominee"

This is very bad reporting by Rawstory, and the same type of spin is being put on it by Sam Stein at Huffpo and also by Crooks and Liars, as my google search for an exact quote shows.

Ironically enough, a more balanced presentation is found right here
