that is, yes, I think everyone agrees that capital crimes (murder, assault, etc) are easily defined crimes in our society.

The gray area starts with you start legislating things like sex and drugs, etc. That doesn't work. Never has, never will. People are people, and will continue to be quite human, no matter how many laws are made.
