Re. Prop 8: Could this bite the fundies in the ass?
The fundies are, of course, appealing the Prop 8 decision, and it will probably go to the Supreme Court.

Would it be possible, even in the Roberts Court, for the Supremes to decide the Prop 8-overturning decision, which says Prop 8 created an underclass of citizenry based on sexual orientation, applies nationwide? Remember that before Roe was decided, there was a patchwork of abortion laws in the US somewhat like there is a patchwork of same-sex marriage laws now.

So...coupling the Prop 8 overturning with Roe, could the fundamentalists accidentally cause same-sex marriage to be legal nationwide? And would it destroy the fundamentalist movement ("YOU did this to us!!!") in its wake?

and it would be not only the proper thing to do (but also amusing to see it happen).

One has to be careful in what they wish for!

How sad it is that he is on the wrong side of history and momentum.

and that's the danger. SCOTUS may rule against us.

If that happens, we may be stuck with the status quo for decades, especially if we can't get any nominations which change the balance of power on the court. This is a very dangerous game, for both sides.

4. I don't think they will though.
There are only really 3 hard-core social conservatives on the Court (Scalia, Alito, and Thomas), the rest are all moderate-liberal, at least regarding social matters. I really wouldn't be surprised if we saw a 6-3 decision against the Prop. 8 appeal, legalizing gay marriage nationwide. This could be the nightmare the fundies never saw coming, and the funny thing is: they brought it all upon themselves!

5. Could the Supreme court legalize marriage equality - maybe
will it hurt the fundies - absolutely not.

They will campaign on amending the US constitution to outlaw marriage equality for decades and raise tons of cash on the issue. Roe v. Wade has been the biggest and most consistent cash cow for years now.
