As someone else has already pointed out, the US is not a signatory to the International Criminal Court (ICC). Even if we were, the subject matter does not fall under the jurisdiction of the ICC. The birthers' concerns hardly fall into the specific categories of genocide, crimes against humanity or war crimes that are the subject matter of the ICC.

If Orly tries to file at the International Court of Justice (ICJ) to which the US IS a party, she'll only find a new forum to rail against.
