Got this in an e-mail...

Everyone may already be aware of this but you may know someone who is not.

BETTER PAY ATTENTION TO THIS ONE. AT $754.00 ALMOST LIKE A D.U.I.

New Law: If a patrol car is pulled over to the side of the road, you have to change to the next lane (away from the stopped vehicle) or slow down to at least 20 mph under the posted speed limit. Every state except Hawaii and Maryland and the D.C. has this law.

In California, the Move-over law became operative on January 1, 2010. http://www.moveoveramerica.com/

A friend's son got a ticket for this recently. A police car (turned out it was two police cars) was on the side of the road giving a ticket to someone else. He slowed down to pass but did not move into the other lane. The second police car immediately pulled him over and gave him a ticket. He had never heard of the law. It is a fairly new law that states if any emergency vehicle is on the side of the road, if you are able, you are to move into the far lane.

The cost of the ticket was $754, with three points on your license and a mandatory court appearance. Please let everyone you know that drives about this new law. It is true (see details at the following web address). www.moveoveramerica.com

3. Why do they even NEED a law like this?
Edited on Wed Sep-08-10 05:47 PM by Ken Burch
How could it possibly be threatening to cops for a car that wasn't pulled over in the first place to quickly move past the pull-over scene? The car that would be speeding past would almost certainly have no involvement at all with whatever caused the first car to BE pulled over.

And a cop would only be at risk of being hit by a car in the lane if he were dumb enough to be standing in the lane at the time. No cop NEEDS to do that if the car he pulled over was actually on the shoulder out of traffic.

4. I never knew the rules before. I do slow if I can't get over but not usually 20 mph slower

of cops at traffic stops getting nailed by cars that don't even bother to slow down. I always have, but thanks for the tip.

6. Maine recently enacted a law like this
Edited on Wed Sep-08-10 06:25 PM by high density
If there isn't already a "curiosity delay" caused by the cop, I find slowing down to 20 under the speed limit is dangerous on most highways. Is it "safe" if I get rear-ended to follow the law?

8. I sincerely hope that slowing your vehicle to 20 or under while passing emergency vehicles even
2-lane highways is true because we've run into numerous police stops while traveling on I-95 and NOT ONE CAR/truck in the left lane will allow you to move over, in fact, they will do their best to tailgate the car/truck in front so you can not move over.

So what is my legal responsibility? Slow down 20 mph or under while passing the emergency vehicle, slow to a near stop (with traffic behind me) or Bogart my way into the left lane?

The last 2 options are recipes for disaster on a big, busy interstate.

IMHO, there should also be a law that MANDATES that all vehicles in the left lane MUST allow right hand traffic to merge into the left lane AND ALL traffic slows down to 20 mph or lower!

10. Exactly.
And I think this law is flawed and in favor of states making bank on drivers who are ticketed.

(yes, law enforcement and emergency workers should be protected but this law is one way, imho).
