Obama wins in court. Appeals court keeps DADT in operation indefinitely per administration request.
SAN FRANCISCO — A federal appeals court extended the military's ban on gays serving openly Monday by indefinitely freezing a judge's order halting enforcement of the so-called "don't ask, don't tell" law, heightening pressure on the Obama administration to persuade the U.S. Senate to repeal the law before a new Congress is sworn in.

A divided three-judge panel of the 9th U.S. Circuit Court of Appeals granted the U.S. government's request for a stay while it challenges the trial court's ruling that the ban on openly gay service members is unconstitutional....

In an eight-page order, two judges said they were persuaded by the Department of Justice's argument that U.S. District Court Judge Virginia Phillips' worldwide injunction against the policy "will seriously disrupt ongoing and determined efforts by the Administration to devise an orderly change."

I can see this slipping away. The Senate has to vote on it. During a lame duck session. McCain has threatened to filibuster it. And of course, the White House and the Senate Democrats will cave completely.

And a chance to do the right thing, to do something POPULAR, will be gone. Just like that.

What's striking about the wording of the DoJ's argument were the words "to devise an orderly change". I've heard Robert Gibbs, Robert Gates all use the word "change" in talking about DADT repeal. "Change" is not, according to MY dictionary, the same as repeal. There was never any real interest in outright repeal. Not from this administration, not from the Pentagon.

Sorry to be so depressing in your thread, Bluebear. But I can't find the optimism in this.

38. Refusing to appeal was the last, best hope --
we had -- it was a gift from the courts and O should have taken it with open arms, but playing midtermn politics was more important. :( He deserves everything that is coming his way for such cowardice.

Yes, it is crappy and needs to be repealed now as it is totally illogical, and against civil rights (imo). I don't get the "blame Obama" bit though as I thought he was trying to do this legislatively via new law vs through courts via old law. I thought it was standard for things to be challenged, to be stayed.

and yes, there is a whole lot of stuff I am unhappy with this administration about. Best things so far are getting someone on the SCOTUS and doing the thing about PELL grants.
