I am sure he is confident it will be repealed in the lame duck session. Otherwise, why appeal the ruling of its unconstitutionality?

Won't it be even harder to repeal with a smaller majority in the Senate?

2. But I've heard that is why he appealed it.
He wanted it repealed in Congress.
