It's the contract he signed. KO is a big enough name that he could have negotiated the contract when he signed on to MSNBC. He could have, at any time, sought an amendment to the contract. He could have, as many others apparently have done, gone to the bosses and gotten approval. He did none of those things. Instead, he violated a contractual obligation that he knew to exist. If there has been disparate enforcement over at MSNBC on this issue, then by all means, he should take them to court and sue them for all they are worth. Otherwise, he should take his lumps, apologize for violating his contractual arrangement, and move on if and when MSNBC is prepared to move on.

Do I believe that MSNBC is using a canon to kill a mosquito here? Yes. That said, few people have as much power in bargaining with employers as popular TV personalities. That he didn't exercise it is folly on his part and, frankly on principal, MSNBC has the right to enforce whatever remedy he agreed they could in the event of a violation. If the network violated agreements with KO, I certainly wouldn't begrudge KO for exercising any rights available to him that he should choose.
