Bad news: Sharia law continues to creep closer to taking over Oklahoma

As many of you DUers know, I've been particularly worried about the prospect of Sharia law being imposed on the State of Oklahoma of late. My concern arises not just from the fact that my aunt lives in Oklahoma City, and that my cousin Jimmy and his wife and child frequently visit the soon-to-be-renamed Oklahomistan, but that I shudder at the thought that the Will Rogers Museum--truly one of America's treasures--will also be subject to the vile jizyah taxes that the Islamic Caliphate was known to impose on the People of the Book in the 14th Century.

Think about that for a second (but no longer).

Obviously, I was greatly relieved when, in a triumph of democracy, the great people of Oklahoma snatched victory from the drooling maws of defeat by their referendum banning the imposition of sharia law anywhere in the state. For the first time in months, I had a sound night's sleep. True, the wording of the law also banned the Ten Commandments, of which certain sects of Oklahomans are particularly fond. But, as Davy Crockett said, better to reign in hell than serve in Texas. Amen, Davy, amen.

But our long national nightmare is not over yet, thanks to some liberal activist elitist federal judge in the United States District Court, Western District of Oklahoma. The lawsuit was brought by the sinisterly named Muneer Awad, who immigrated to this country from Athens, Georgia, and now serves on a range of insidious sounding so called organizations, such as Council on American-Islamic Relations, Central Oklahoma Human Rights Alliance, and the Peace House. The "Peace House", really? Sieg heil, comrade!

Now the lurking confabulations of international Islamic domination are creeping their sucker-gripping tentacles ever closer to strangling freedom in the Sooner State, for the fellow travelers lurking in the fluorescent shadows of the US District Court Building, Western District of Oklahoma have granted a stay of that last prophylactic of security between burkha-imposition and my sweet little auntie. And what legalistic mumbo jumbo does the court use to back up this blatant fifth-columnizing? I don't know, I can't find it in any of the tubes of the internet. But here's what some pro-Muslim extremist told NPR:

Marc Stern, a First Amendment lawyer with the American Jewish Committee, says there's no way that fundamentalist Islamic law will be imported here.

"Stoning, cutting off of hands, people being forced to wear veils and the like are simply not going to happen with the assistance of the courts," Stern says.

So what would the new amendment do? Stern says it would favor other religious practices over Islamic ones. For example, Stern says, it is common for a court to accept a will, a prenuptial agreement or a contract based on religious law.

"This amendment seems to say the courts can take no notice of Shariah law," he says. "It doesn't say you can't take notice of canon or Jewish or any other form of religious law that imposes requirements on religious believers. That, alone, would seem to be grounds for throwing this out."

Touche, Brute, touche, indeed.

The clouds gather darkly, my friends, darkly and troublingly. The freedoms that Oklahomans cherish hang by a thread. Soon the state will be steeped in religious dementia, hounded by posturing clerics, perhaps even attempting to impose partial bans on alcohol and limiting its use to private clubs. The mind reels. Even now, I imagine, Iran and Saudi Arabia are conspiring to flood the state with fatwas and zakāts. I call on President Obama to send in the troops and protect us all from this foot in the door of sharia law--for as goes Oklahoma, so goes Kansas and parts of western Arkansas. The dominoes, my God, the dominoes! Already the religious crazies of Oklahoma are threatening the very economy of the state!

The amendment opens a Pandora's box of legal problems aside from the First Amendment issues, says Joseph Thai, a law professor at the University of Oklahoma's College of Law. It would bar courts in the state from recognizing all international law, including treaties and international business contracts that are often based on foreign law. He wonders, why would any foreign company do business with Oklahoma?

"I think this hurts Oklahomas economy because it chills international investment to the extent that international investors rely on international law to protect their contract rights," Thai says. "I think it also hurts Oklahoma more broadly because it makes Oklahoma seem like a less welcoming place for outsiders."

55. How do you get less welcoming than Oklahoma already is?
When the state motto is "If You're Not White and Christian, Stay the Fuck Away," the state bird is the one-finger salute and the state song is "Onward Christian Soldiers, Marching as to War," it's kinda hard to feel at home there.

Thank God Kansas is just next door so you can dip across the state line for a dose of sanity every now and again.

Look at those people. See the big smiles? Though you don't see it in that picture, but people actually brought their children to lynchings. The events were advertised in the paper and on the radio. it was a social event on par with a county fair.

That sort of thing doesn't just disappear overnight. That acceptance, that urge to perpetuate it, just the sheer JOY these people had at killing black people... that didn't go away. It's still there, you can't just expect a societal psychosis of that magnitude to slip away into the night. And if you think the passage of civil rights laws converted these people, you're deluded.

These people - or rather, people who've picked up those proverbial torches - are still around and still looking for ways to get what they want. There's no "Was."

In all seriousness, i have a lot of deep ties to Oklahoma. I went there as a kid to my Grandmothers small dairy farm south of Tecumseh. I spent many a great summer up there. She was a life long FDR new deal democrat to the day she died in 2005. Both of my parents were born there and they tell me it has changed so much. They say that it was never filled with these types of looneys we see today. They seem to think the early 1980's, late 70's is when everything started going south.

got 30% of the vote in Oklahoma in 1920. Oklahoma always had a long history of union strength and people like Woody Guthrie.

In criminal law, to prove a stated degree of offense, it is often required to prove a particular mental state of intent.

For example, if I enter your home without permission for the purpose of committing a crime therein, it is a species of burglary. What matters is what is going on in my head at the time of entry. If I say "I thought it was my house, and was just confused" then there may, or may not, be other evidence suggesting I was or was not thinking about committing a crime.

Sometimes people's beliefs will impact the intent element for a given crime, and it's weird how that one case in New Jersey gets distorted. Nobody said it was okay what he did, and he may have been guilty of a different offense than the one under which he was charged on that one count.

You have to wonder that legislators don't have any access to legal advice as to how ridiculous these laws are, legally. We're electing representatives who don't even know their own role in the system. Or, they are just using these issues to grandstand.

It's coming across the border, I can see it! I can see the Muslim world from my front porch. We used to have to go to private clubs to buy a drink. There was no liquor by the drink. You had to be a member of a private club and then buy a liquor card to have a drink served to you. Oh my god, it's coming back, only this time it is wearing a turban!

Premier Dalton McGuinty said today Ontario will reject the use of Sharia law and will move to prohibit all religious-based tribunals to settle family disputes such as divorce.

His announcement comes after hundreds of demonstrators around the world this week protested a proposal to let Ontario residents use Islamic law for settling family disputes.

Ontario has allowed Catholic and Jewish faith-based tribunals to settle family law matters on a voluntary basis since 1991, but the practice got little attention until Muslim leaders demanded the same rights.

but i am sure there was something about making no laws regarding religion. wouldn't this kind of law qualify as that which the government can't do?

That's void for being overbroad.

All our law in the U.S. comes from England, France and Spain, as far as I know.
So they are trying to remove ALL laws in Oklahoma.
