Scotts Miracle-Gro names former EPA head to board


The Scotts Miracle-Gro Co. has named former U.S. Environmental Protection Agency administrator Stephen Johnson to its board of directors.

The company said Thursday Johnson's appointment is effective immediately. Scotts is the world's biggest maker of branded consumer lawn and garden chemicals.

Johnson began working at EPA in 1979 and held multiple roles during his tenure until being named Administrator by President George Bush in 2005. He was the first career employee and scientist to lead EPA.

Johnson fills the term formerly held by Mark Baker, who recently resigned from the board. That term expires in 2013.

In May 2008. The Scotts Miracle-Gro Company and a number of Scotts affiliates recalled four pesticides that EPA alleges were unregistered, falsely and misleadingly labeled, or both. The recalled Scotts pesticides used the following false or actual EPA registration numbers:

* 538-299 “Turf Builder Pre/Post 2” or “Scotts Turf Builder Max Plus 2 Weed & Feed And Crabgrass Preventer”
* 538-301 “SouthernMax” or “Scotts Bonus S Max Southern Weed & Feed and Fire Ant Killer”
* 62355-4 “Garden Weed Preventer + Plant Food” or “Miracle Gro Shake 'n Feed All Purpose Plant Food Plus Weed Preventer” and
* 538-304 “SLS Fertilizer With .28 Halts,” “0-0-7 Plus .28% Halts Pro,” “22-0-8 Plus .28% Halts Pro” or “14-2-5 Plus .28% Halts Pro”

Retailers Ordered to Pull Illegal Miracle-Gro Pesticides

Under the Federal Insecticide, Fungicide and Rodenticide Act, all pesticides must be submitted to the EPA for review, evaluation and registration to ensure they do not pose an unreasonable risk to human health or the environment.

The EPA's review and registration process is internationally recognized, and the agency says pesticide products that have not undergone an EPA review may pose unwanted risks to human health and the environment.

"EPA will fully investigate this violation and take appropriate actions," said Gade. "We are committed to keeping the public informed about any health consequences and providing information to assure the safe recall of these products as soon as possible."

With more than $2.9 billion in worldwide sales and more than 6,000 associates, Scotts is the world's largest marketer of branded consumer products for lawn and garden care.

Environmental attorney Sanders says EPA issued a “stop sale, use or removal” orders to Scott Miracle-Gro in April 2008, where was notice to consumers??


Perhaps like you, I love to plant and work in a small garden at my house during the spring and summer. I normally do not use pesticides because of the potential harm to beneficial insects. Sometimes, however, a small amount of pesticides may be necessary due to an unexpected insect infestation. During those times, I rely solely on the labeling of such products to make that they are safe for their intended use.

So, it was a tremendous surprise when I just learned that about one year ago, U.S. EPA Region 5 issued “stop sale, use or removal” orders to Scotts Miracle-Gro Co. and two affiliates, barring the distribution and sale of two more misbranded pesticides. I certainly do not recall seeing a notice or other information about this recall at my local garden supply store last year.


Labels on both products make false or misleading claims and one product lacks safety instructions as required by EPA. Products affected by these orders are “Scotts Bonus S Max Southern Weed & Feed And Fire Ant Killer,” “Scotts Turf Builder Max Plus 2 Weed & Feed And Crabgrass Preventer” and related pesticide products which can be identified by EPA registration numbers 538-301 and 538-299 listed on their packages. Both products are currently registered with EPA. EPA requested and Scotts agreed to carry out a recall of these two products.

According to U.S. EPA, a pesticide is misbranded if its label makes false or misleading claims, or does not provide required warning or caution statements that protect public health and the environment. For example, first aid instructions such as “Call a poison control center or doctor for treatment advice” may be necessary.

I am sure the news folks at 24x7x365 news stations (well, lets make that 24x7x365x -fox, cnn1, cnn2, msnbc- and major papers) will check in on this to make sure there is no conflict of interest and that there was no undue influence with the promise of a high paying job, etc...

Ehhh so what? Yes there could be a problem if Stephen Johnson were to use his influence to pressure the EPA to look the other way; but recalls and fines are costly to companies, and it is smart for the company, consumer and environment, to have someone on board that can prevent the mistakes in the first place.

5. HA! Do you really think he's going to be in a Compliance Office
position, making sure their products are safe?

Or will he be a lobbyist, using all his connections at the EPA to help make sure the company navigates the EPA as easily and smoothly as possible with the minimum of fines and complications?

History tells us that companies that hire top government people always, always, always put them into lobbyist or executive positions. They were hired for their knowledge of the agencies and offices they used to head. They were hired for their knowledge of the people still working in those agencies and offices, and their relationships with those people.

Putting this guy in an lab, getting him to supervise the compliance of products with EPA guidelines, would ideally be in the best interest of customers. But it would not be in the best interest of the company's bottom line. They make far more money by exploiting him as a lobbyist.
