.......Have you wondered over the past several days WHY no TV host have not asked the TSA where it says in administrative law that you waive your right refuse this procedure once you buy an airline ticket... So far for me I have heard no agent of the TSA cite the page and paragraph where their authority comes from....nor have they had an airline management REP on to asked them where it is a condition of travel written into their ticket contract..

.....Also why is there no signage at the airport at the security line indicating that passage beyond this point is conditioned on your forfeiting your privacy.......

3. Such is the power of general 'regulatory' law. They get to decide.
It's the same for the BATFE, or the IRS (in many cases, not all).

As far as the power of the TSA goes, it's more of a deal between major airlines and the government than it is a broad power.

Hint: google TSA-free flight and you'll see some quite decent sized airlines flying around without a pat-down / scan / etc.

Thanks to a 2002 expansion of the regulatory power to denote something as 'sensitive security information', even the TSAs own public procedures can't be disclosed. They can't tell you, because they said so.
