If not your own publisher or publicist, who else had access? Wouldn't it be smarter to sue THEM?

Madonna tried to run the same game at the height of the Napster controversy. A leak from her new album appeared online, and she got free advertising by screaming about the evils of downloading. If her publicist, record label or recording studio didn't leak the file, who else could have?
