My apologies, I am not sure where to post this question (TSA-related)
I have read that the TSA have the "legal authority" to levy a $10,000 "civil penalty" to passengers who refuse both the scanner and the enhanced pat down and wish to abort the security process and leave the airport rather than board their plane.

Does anyone know what statute gives them this authority? I'd like to know what the actual law is.

1. It's probably a little-known amendment to the Patriot Act.
That has got to be what they are going to use for this intrusion - how else do they get past the 4th amendment?

Under 49 CFR Sec.s 1540.105 and 1540.107, as summarized in these 2004 TSA Sanction Guidelines, apparently TSA has Congressional support to fine people for refusing to submit to molestation.
