I know he is appealing his sentence but is he doing it from behind bars or is this scum walking the streets?

1. My understanding is that he was not sentenced yet.

Sentencing can be months after a verdict, especially if the criminal is a "white-collar" criminal. And you ordinarily don't get to withhold serving your sentence while appealing, but instead have to do it from behind bars.

7. It's quite likely. The judge could cite "circumstantiality of the evidence"

and give him probation. That assessment was in an article I read. Personally, I doubt he'll ever do real time behind bars. He made a difference in Texas' redistricting, and he'll be rewarded for that with no jail time. That's why I celebrated last night. Hit Tub Tom has many friends in high places. I just don't want to see his ray-bastard face in politics or in the media after sentencing.

17. The judge in the case is a fair, honest and good man and

he's a damn good Democrat. He is a visiting retired judge from San Antonio. He was specifically selected due to his excellent reputation on both sides. Early on, Delay tried to get him thrown out due to him being a Democrat. Because he is that good, the request was denied.

and "miscarriage of justice" in his obligatory sound-bite on NPR this morning.

I bet it never crossed his mind the jury might bring in a "Guilty" verdict.

This saga does remind me of the old Sam Levenson bit on the "Ed Sullivan Show" -- Sam said when a button fell off his shirt, his mother would just sew the buttonhole shut, so no problem.

The current crop of corporate shills on the SCOTUS will no doubt say the crime DeLay committed no longer exists, therefore no need for the "criminal" to serve any time.

In fact the Scalito-Roberts-Thomas cabal may give him a letter of commendation for leading the way in creative campaign funding.
