Mouthing the words "Not true",with no discernible intent to publicly mock the president, is really pretty different than yelling "You Lie" in a silent room with the nation watching. He had no idea he was on camera at that moment.

Do you really think that every Dem in the room agreed with everything the president said? That no one ever shook their head in polite disagreement? Rolled their eyes? Come on DU this is pretty silly stuff.

5. For the tiny bit it's worth, I agree with that.

He probably even knew a camera would notice it, but he didn't do it in a way to interrupt the speech, and it clearly wasn't a planned action, like Wilson's. If it were one of ours, we'd be applauding and trying to name a star after him. It didn't bother me much.

Now the rest of what Alito does bothers me greatly...

I've disagreed with the president and said so. There's nothing new here.

It's one thing for Helen Thomas to mutter under her breath at a press conference. But Justice Ginsberg? Please, no.

6. It has nothing to do with disrespecting the President

It is not the judicial equivalent of Joe Wilson. Joe Wilson is a politician, Samuel Alito is an Associate Justice of the United States Supreme Court. Judges have an ethical duty not only to be impartial but also to appear impartial in their public comments. For a justice to make a public display of partisanship is a big deal from a standpoint of legal ethics. Is it the end of the world? No. But it's a big deal.
