In fact, under the 14th Amendment, the counter-argument is true. The system we've had in place has been unconstitutional!

And it's what the SCOTUS used to vote in favor of abortion rights in Roe v. Wade. Americans who do not have access to health care because of private company restrictions do not, in fact, have their 14th Amendment rights.
