Check in if you're really proud of the Dems. in the Senate tonight.
They're sticking together no matter WHAT amendments the Repubs. put up to try to force them to change the bill. They could offer an amendment saying, "To refuse letting mothers punch their children in the face" and the Dems. would dismiss it and vote against it. Good for them!

10. Better to take them on sooner rather than later.
The more that the Republicans play to their base, the more marginalized they become.

Its a long time between now and the elections, it will be very tough to keep their voters at this fever pitch until then. Of course, if they don't do things to appeal to the tea baggers, the tea baggers will turn on them.

I say we stick with our agenda and keep the pressure on them. Most Americans will see our agenda as responsible action. It will cause the Republicans to be more extreme.

I just hope no one gets hurt.

34. Surprised and delighted
I just kept going back to C-Span last night to watch the votes. I was just so shocked, stunned and delighted to see the Dems in the SEnate actually keep a promise to the Dems in the House. It was a real "We got your back!" moment for the House, the Dems and America, as far as I'm concerned. I enjoyed seeing them take hard votes against some of the stunt amendments the GOP put out there. I just ... man. Every time I heard a name of a senator I don't usually like - even Lieberman, for the love of pete! - I just got goosebumps to see them support the Democratic agenda.

On the other hand, I cursed every time I heard "Nelson of Nebraska" or "Lincoln of Arkansas." A-holes.

And Olympia Snowe STILL grinds my gears! What a disappointment she's been. One of the few left I thought might be rational. So much for that.

Please turn to Page 336 of the Senate bill, whose language has been adopted in the Obama proposal:

In the case of any failure by a taxpayer to timely pay any penalty imposed by this section, such taxpayer shall not be subject to any criminal prosecution or penalty with respect to such failure.

On that same page, it says the Health and Human Services secretary shall not

file notice of lien with respect to any property of a taxpayer by reason of any failure to pay the penalty … or levy on any such property with respect to such failure.

Huh. "Compliance," Jost concludes,

will therefore be largely voluntary (although the IRS can still make a tax resister's life miserable, whether or not it can ultimately collect). The state bills can thus be seen as invitations to civil disobedience that counsel state citizens to "violate the federal law, wave this statute in their face, and dare them to come after you."

When the late Virginia Sen. Harry Byrd declared war on Brown v. Board of Ed., the result was a few years of defiance at the state level, a lot of newspaper columns and public statements that James J. Kilpatrick came to regret, and eventual capitulation. When the state of California maintained its medical marijuana program in defiance of federal law, the result was a lot of busts by the feds followed by a decision by Attorney General Eric Holder that he had better things to do than prosecute a lot of dopers with medical conditions.

In both those instances, defiance led to legal battles and sometimes to prison sentences. Defying the individual mandate will probably lead to some court battles, too, but once the constitutional issues are settled (probably in the individual mandate's favor), there won't be much left to fight about. And apparently there won't be any threat of prison time or financial penalty. There will only be the threat of pissing off the IRS—and Republicans in Congress may be hyper-vigilant about policing any audits perceived to be retribution for noncompliance."






From the bill:

23 ‘‘(5) INSURANCE-RELATED TERMS.—Any term
24 used in this section which is also used in title I of
336
HR 3590 EAS/PP
1 the Patient Protection and Affordable Care Act shall
2 have the same meaning as when used in such title.
3 ‘‘(g) ADMINISTRATION AND PROCEDURE.—
4 ‘‘(1) IN GENERAL.—The penalty provided by this
5 section shall be paid upon notice and demand by the
6 Secretary, and except as provided in paragraph (2),
7 shall be assessed and collected in the same manner as
8 an assessable penalty under subchapter B of chapter
9 68.
10 ‘‘(2) SPECIAL RULES.—Notwithstanding any
11 other provision of law—
12 ‘‘(A) WAIVER OF CRIMINAL PENALTIES.—In
13 the case of any failure by a taxpayer to timely

looks like a loophole. I think O'Donnell (and Ed Schultz?) said it was REPEALED, which seems not to be the case, but it's still not punishable if you don't pay it.
