Bachmann: Why is there a Department of Education?

(CNN) - Painting herself as a "constitutional conservative" Minnesota Rep. Michele Bachmann told Sen. Jim DeMint's forum Monday that if elected president she would look to get rid of the Department of Education, among other things.

"Because the Constitution does not specifically enumerate nor does it give to the federal government the role and duty to superintend over education that historically has been held by the parents and by local communities and by state governments," she said, responding to a question by DeMint, a popular figure among the tea party movement.

5. Michele is a nitwit. I can't believe she actually went to law school -
because she should have learned there that Congress can delegate to federal agencies like the Department of Education certain regulatory powers without violating the separation of powers requirement of the Constitution. This is called the Delegation Doctrine, and it has been repeatedly upheld by the Supreme Court. But then, Michele got her law degree from Bible Thumper U., where they teach you how to ignore the Constitution to get more Jesus into the government.

21. I need to look up which law school she went to.
I don't want to apply there if I ever decide to go to law school, and I wouldn't want to hire a lawyer who went there either.

16. It wasn't all that long ago that each state was responsible for its own
schools. I attended school during that time. I think the quality of schools varied from state to state but that is also true today. I honestly do not remember why it was later handed over to the feds. Probably to lower property taxes.
