Obama elevates a young asian female judge to a high court & quickly, setting up potential SCOTUS nod
Edited on Thu Sep-22-11 11:39 PM by usregimechange

Judge Jacqueline H. Nguyen: US District, Central District of California
Nominee for the United States Court of Appeals for the Ninth Circuit
46 years old

She was nominated by Obama in July of 2009 and confirmed in December of that year. He is elevating her very quickly.

http://www.whitehouse.gov/the-press-office/2011/09/22/president-obama-nominates-judge-jacqueline-h-nguyen-serve-united-states-

"The journey to the upper echelons of the nation’s judicial system has been a long one for Nguyen. It started in 1975, when 10-year old Nguyen fled her native Vietnam with her family after the fall of Saigon. They boarded one of the last American military transports out of the city, and spent several weeks in a refugee camp in the Philippines before arriving at Camp Pendleton Marine Corps Base near San Diego."

Stay tuned.

5. Elena Kagan was 51 when she was confirmed.
Ginsburg is 78

Kennedy and Scalia are 75.

John Paul Stevens was 91 when he stepped down.

On Ginsburg:

With the retirement of John Paul Stevens in 2010, Ginsburg became, at 77 years of age, the eldest justice on the Court.<32> Despite rumors she would retire as a result of old age, poor health, and the death of her husband,<33><34> she denied she was planning to step down. In an August 2010 interview, Ginsburg stated that the Court's work was helping her cope with the death of her husband and suggested she would serve until at least 2012 when a painting that used to hang in her office is due to be returned to her.<32> She also expressed a wish to emulate Justice Louis Brandeis, who retired at 82,<32> an age that Ginsburg would attain in 2015.

http://en.wikipedia.org/wiki/Ruth_Bader_Ginsburg#Illness

After nearly a quarter century on the Court, and now past the age of seventy, Scalia characterizes his victories as "amn few".<109> His biographer, Joan Biskupic, speculates that Scalia, given good health, may remain on the Court for another decade.<109>

http://en.wikipedia.org/wiki/Antonin_Scalia#Assessment

Breyer is 73 and healthy. Kennedy is also healthy.

Conclusion:
Basically, one of these three would rapidly have to develop a debilitating condition in the next 5 years for Obama to appoint a replacement.

Maybe Scalia will have a heart attack, but otherwise Obama is not likely to get another nominee.

6. Odds are pretty high that a 4 year term yields at least one nominee
Edited on Thu Sep-22-11 11:46 PM by usregimechange
Carter I think was the last POTUS that didn't have at least one.

13. Obama has had 2 in the first term.
That meets your average expectation. I just don't see the make-up of the court changing until after 2016.

23. Here ya go
Eisenhower appointed: 5
Nixon appointed: 4
Reagan appointed: 3

p.s. There is absolutely no reason at all to think that Pres Obama wouldn't be able to appoint FOUR during his eight years.

I don't. I expect decades of Democratic governance.

15. I believe Obama will have the opportunity to nominate TWO more Supreme Court Justices.
Ruth Bader Gingburg will most likely retire sometime between 2013 and 2016.
She has stated it will be sometime 'after' a painting she owns that is currently 'out on loan' returns.

17. So Ginsburg steps down early - but why would Kennedy let a Dem replace him?
He's had his feuds with Scalia/Thomas but Roberts seems to be along his alley.

21. Kennedy is not going anywhere, I think Citizens United spoke to that.
And if he does, my assumption is that he will wait for a Republican appointment. Which is really sad, I was disappointed in his Citizens United ruling but I do like him as a Justice. He McGeorge BABY!

24. Only God knows who/when/if someone were to have a heart attack and die...
or get run over by a bus or whatever in during the next five years.
But it is a possibility.

29. OK,let's hear people demonize her
The way they demonized the last two LADIES Obama put into the SCOTUS, funny, if a President Hillary had put them in, Jane Hamsher and Arianna would use them as proof positive that she was the right choice for President.
